On July 31, 2017, Cotter Corporation (N.S.L.) ("Cotter") responded to your <br />letter insofar as it covers the permit for the CM -25 Mine. Cotter here responds to your letter <br />insofar as it covers the permit for the SR -13A Mine, which has been in temporary cessation since <br />December 15, 2012. Cotter is submitting a separate response to your letter insofar as it covers <br />the permit for the C -LP -21 Mine, which also has been in temporary cessation since December <br />15, 2012. <br />As more fully set forth below, and consistent with your letter to Cotter dated June 29, 2017 <br />regarding the JD -9, JD -6, and JD -7 Mines, Cotter requests that the permit for the SR -13A Mine <br />remain in temporary cessation for a second five-year period commencing December 15, 2017. <br />Cotter also requests a hearing before the Mined Land Reclamation Board ("Board") pursuant to <br />Colo. Rev. Stat. § 34-32-103(6)(a)(III) and Hard Rock/Metal Mining Rule 1.13.5(1)(b) to <br />confirm such status. <br />Your letter addressing the SR -13A Mine reports initially that, on May 7, 2013, the Board signed <br />an order approving Cotter's request to put the permit for the SR- I3A Mine into an initial five- <br />year period of temporary cessation, effective December 15, 2012. While Cotter agrees with this <br />assessment, it respectfully adds that its request to put the SR -13A Mine into temporary cessation <br />was made at the request of the Division of Reclamation, Mining and Safety ("Division"), as set <br />forth in the Division's letter to Cotter dated November 9, 2012. <br />Cotter respectfully disagrees with the statements in your letter that the SR -13A Mine has reached <br />its permit conclusion and that Cotter must now request a release of its permit and associated <br />financial warranties. Substantial economic reserves continue to exist in the SR -13A Mine, and <br />these reserves can be mined in the future. This fact was acknowledged in the Division's <br />inspection report for the SR -13A Mine, signed July 26, 2010: "The mine was closed due to <br />economic conditions.
