On July 31, 2017, Cotter Corporation (N.S.L.) ("Cotter") responded to your
letter insofar as it covers the permit for the CM -25 Mine. Cotter here responds to your letter
insofar as it covers the permit for the C -LP -21 Mine, which has been in temporary cessation
since December 15, 2012. Cotter is submitting a separate response to your letter insofar as it
covers the permit for the SR -13A Mine, which also has been in temporary cessation since
December 15, 2012.
As more fully set forth below, and consistent with your letter to Cotter dated June 29, 20I7
regarding the JD -9, JD -6, and JD -7 Mines, Cotter requests that the permit for the C -LP -21 Mine
remain in temporary cessation for a second five-year period commencing December 15, 2017.
Cotter also requests a hearing before the Mined Land Reclamation Board ("Board") pursuant to
Colo. Rev. Stat. § 34-32-103(6)(a)(I11) and Hard Rock/Metal Mining Rule 1.13.5(1)(b) to
confirm such status.
Your letter addressing the C -LP -21 Mine reports initially that, on May 7, 2013, the Board signed
an order approving Cotter's request to put the permit for the C -LP -21 Mine into an initial five-
year period of temporary cessation, effective December 15, 2012. While Cotter agrees with this
assessment, it respectfully adds that its request to put the C -LP -21 Mine into temporary cessation
was made at the request of the Division of Reclamation, Mining and Safety ("Division"), as set
forth in the Division's letter to Cotter dated November 9, 2012.
Cotter respectfully disagrees with the statements in your letter that the C -LP -21 Mine has
reached its permit conclusion and that Cotter must now request a release of its permit and
associated financial warranties. Substantial economic reserves continue to exist in the C -LP -21
Mine, and these reserves can be mined in the future. This fact was acknowledged in the
Division's inspection report for the C -LP -21 Mine, signed July 30, 2010: "The mine was
reclaimed due to economic reasons and not ore reserve depletion.
