Operator based on fifty-five days of violation at $50 to $200 per day for a civil <br /> penalty of$2,750 to $11,000. <br /> ORDER <br /> Based on the foregoing findings of fact and conclusions of law, the Board finds <br /> the Operator in violation of section 34-32-116(7)(h), C.R.S. for failing to protect <br /> areas outside the affected land from slides or damage occurring during the mining <br /> operation or reclamation and section 34-32-116(7)(1), C.R.S. for failing to stabilize <br /> and protect all surface areas of the affected land so as to effectively control erosion. <br /> The Operator shall CEASE AND DESIST all further mining activities at the <br /> site, with the exception of those activities, approved by the Division in writing, as <br /> necessary to comply with the conditions of this Order, prevent damage to off-site <br /> areas, or protect public health and safety, until Operator complies with all <br /> corrective actions set forth herein to the satisfaction of the Division. <br /> The Board imposes the following CORRECTIVE ACTION against Operator: <br /> Operator shall submit to the Division an amendment application to increase the size of <br /> the current 110(2) reclamation permit to include the affected lands outside of the <br /> approved permit boundary. Operator shall file a complete amendment application <br /> within sixty days of the effective date of this Order, with all material in an approvable <br /> form within statutory deadlines. <br /> The Board imposes a CIVIL PENALTY for fifty-five days of violation at two <br /> hundred dollars per day for a total civil penalty of$11,000. All but $100 of the civil <br /> penalty is suspended if the Operator complies with the corrective actions. The <br /> portion of the civil penalty not suspended, $100, shall be due and payable within <br /> thirty days of the effective date of this Order. If the Operator does not comply with <br /> the corrective actions set forth in this Order, then the suspended penalties, $10,900, <br /> shall be due and payable.
