This is the same mapping as that submitted for the original Chavers Mining Resource which <br />approved both defined areas without any issues in 2015-2016. ASCI has simply dovetailed onto both boundary <br />limits with this amendment. Please see attached maps 1. and 2. showing what is described here between the two <br />Exhibit C -2's with the original approval and this amendment. There is to be no mining within or near to the <br />channel of the South Platte River. All will be clear at the Pre -Op Inspection. <br />EXHIBIT L (RECLAMATION COSTS): The finalization of this Exhibit will be completed by the applicant <br />and the DRMS at the close of the adequacy review period and prior to approval of the amended permit. The <br />original Ex. L is again being submitted with this response and probably will be adjusted by the DRMS in the <br />time frame required. <br />EXHIBIT N (LEGAL RIGHT TO ENTER): A new "Legal Right to Enter" is being submitted with this <br />response letter that gives the right by Hunt Brothers Properties, Inc. to allow Asphalt Specialties Co, Inc. <br />("ASCI") the right to apply for the amendment and to mine and reclaim the property. Dan Hunt is the president <br />of both companies. The Warranty Deed conveying the property to Hunt Brothers was sent to you previously. <br />EXHIBITS PERMANENT MAN-MADE STRUCTURES): There are no other permanent man-made <br />structures within 200 ft. of the mining limits on this amendment area other than the CDOT erosion control <br />structures on the northern edge of the mining area and US Hwy. -85. Submitted with this response letter is an <br />original signed and notarized agreement (replacing the 2016 agreement) between CDOT and ASCI allowing <br />ASCI to mine within 200 ft. of both US Hwy -85 and the erosion control "spur dikes" on the northern edge of <br />the amendment area. <br />This concludes my responses to the second adequacy review.
