AMOI <br /> August 1, 2017 DRVIS Inspection— Ruiz/Birminghatn Drainage Area <br /> Dear Eric: <br /> This letter to]lows on your August 1, 2017 inspection of Phase 3 and 4 of the Ilolton/Morton <br /> Lakes site and the Ruiz-Birmingham drainage area east of Highway 85, as well as my letter of <br /> the same date that I supplied to you at the inspection. Key facts and findings from the inspection <br /> and our August 1 letter confirm the following: <br /> (a) sources of eater in the drainage area appear limited to seasonal surface flow frotn <br /> upstream areas. direct precipitation. and storm drainage, <br /> (b) the drainage area historically shows large fluctuations in size and extent: <br /> (c) RMCC holds the right to utilize water rights associated with the Ifolton Seep <br /> owned by Holton Family, LLC: <br /> (d) neither the Ruiz'. Birmingham's or others in the West Hill Ct. subdivision own <br /> water ri(Thts associated with the drainage area or the i lolton Seep Ditch: and <br /> (e) even if operations in Phase 3i4 are impacting the drainage area. such impacts will <br /> be temporary because they are set to conclude at the beginning of 2018. <br /> The following additional information is being supplied to support the DR141S' inspection findings <br /> and our August I letter. <br /> Additional Aerial Photos <br /> In addition to the aerial photos we supplied with the August I letter that date from 1993. 2004 <br /> and 2006. our water engineering consultant.
