RECEIVE <br /> AUG 7 8 2017 <br /> BEFORE THE MINED LAND RECLAMATION BOARD 'OIVISION OFRFc <br /> STATE OF COLORADO "1111yGAIVD.AF�, IEGrI�N <br /> rr <br /> REQUEST FOR EXTENSION OF HEARING DATE <br /> Reason to Believe a Violation exists <br /> MV-2016-056 <br /> BATES-HUNTER MI <br /> PERMIT NUMBER M-1990-041 <br /> This law firm represents Central City Consolidated Mining Company ("Permittee"), which <br /> holds DRMS mining permit number M-1990-041. <br /> Permittee has received a Reason to Believe a Violation exists as captioned above,based on an <br /> assertion that it has failed to submit a financial warranty set by the Division of Reclamation <br /> Mining and Safety. Permittee had submitted a Technical Revision(January 27,2017) that, if <br /> approved,would have changed the scope of work of reclamation and therefore the basis on <br /> which the financial warranty was to have been calculated. After two requests to extend the <br /> decision date,the Division denied the Technical Revision(July 11, 2017). Permittee appealed <br /> that denial, asserting several grounds. If the appeal is granted,the financial warranty will need to <br /> be recalculated. The appeal has not been decided yet. Under the circumstances,the current <br /> Reason to Believe a Violation Exists is not ripe for consideration by this Board. <br /> This matter is set for a hearing at the regular Board meeting on August 23 and 24, 2017. There is <br /> no current mining activity on the Permit Area, and the issue to be considered at this hearing does <br /> not deal with any imminent risk of harm to public health or the environment.
