Randall, Executive Director | Virginia Brannon, Director <br />1313 Sherman Street, Room 215 <br />Denver, CO 80203 <br /> <br /> <br />August 18, 2017 <br /> <br /> <br />Steve White <br />Montrose County Planning & Development <br />Director <br />317 South 2nd Street <br />Montrose, CO 81401 <br /> <br /> <br />Re: New Horizon North Mine (Permit No. C-2010-089) <br /> Permit Revision Application No. 2 (PR-2) <br /> Postmining Land Use Change on Garvey & Co Property <br /> <br /> <br />Dear Montrose County Planning & Development: <br /> <br />The Division of Reclamation, Mining and Safety hereby issues notice, in accordance with Title 34, <br />Article 33, Section 118, Paragraph 3, of the Colorado Revised Statutes, that on August 18, 2017, a <br />permit revision application for a permit to conduct coal mining operations, Permit No. C-2010-089 <br />by Elk Ridge Mining and Reclamation, LLC, was considered complete for the purposes of filing. <br />All review and comment periods as provided in the Colorado Surface Coal Mining Reclamation <br />Act and the Rules and Regulations of the Colorado Mined Land Reclamation Board for Coal <br />Mining initiate from this date of filing. <br /> <br />PR-2 is proposing to change the post mining land use on Garvey & Co Property. The topsoil <br />handling plan, revegetation plan and irrigation design will also be changed to accomodate the new <br />post mining land use. The applicant is not proposing additional surface disturbance outside of the <br />area currently approved for disturbance. <br /> <br />The surface coal mining operation is located approximately 2.5 miles Northwest of Nucla. The <br />permit area is further described as follows: <br /> <br />Portions of Sections 25 and 36, T 47 N, R 16 W, N.M.P.M. <br />
