<br /> <br /> <br /> 28 <br />criteria and procedures of 4.16. <br /> <br />For the Garvey property, the land uses and sizes will remain the same as the pre-mining <br />land use but will be in a different location. The change in locations will accommodate <br />the configuration of irrigation designs which include a center pivot. Areas with a pre- <br />mining land use of Grazingland Sagebrush and Grazingland-Subirrigated will be <br />converted to Dryland Pasture. Areas with a pre-mining land use of Dryland Pasture, <br />Irrigation Canal, Grazingland-Subirrigated, Residential and Roads will be converted to <br />Irrigated Pasture. A letter from the land owner consenting to the proposed post mining <br />land use is in Appendix 2.05.5-1. <br /> <br />The entire Meehan parcel, with the exception of the undisturbed Meehan Draw, will be <br />reclaimed to a post-mining land use of Dryland Pasture. This results in a change for 21.9 <br />acres of pre-mining Irrigated Pasture, 14.4 acres of Grazingland – Sagebrush, 2.1 acres <br />of Grazingland – Subirrigated, and 1.1 acres of disturbed areas. Productivity for Dryland <br />Pasture will be superior to that achieved for all except the irrigated pre-mining land uses. <br />Although none of the reclaimed area will be irrigated throughout the liability period, <br />those areas where irrigation may be feasible in the future will be reclaimed in a manner <br />similar to that used for Irrigated Pasture reclamation, e.g. topsoil redistribution and <br />seedbed preparation. A letter from the land owner consenting to the proposed post <br />mining land use is in Appendix 2.05.5-1. <br /> <br />On the Glasier property, all areas, except the undisturbed northwest corner, will be <br />reclaimed to a post-mining land use of Dryland Pasture. Pre-mining land uses of <br />Grazingland-Sagebrush (15.8 acres); Irrigated Pasture (21.1 acres); and residential / <br />agricultural disturbance (including roads) (1.85 acres) will be converted to Dryland <br />Pasture, as will several small zones of non-jurisdictional wetlands. As with the Meehan <br />property, productivity of the reclaimed land will be superior for all conversions, except <br />for areas that were irrigate prior to mining (the landowner has not leased ERMR his <br />shares of water). In these cases, topsoil replacement and seedbed preparation will be <br />conducted so as to allow future irrigation of the property, following bond release. A <br />letter from the land owner consenting to the proposed post mining land use is in Appendix <br />2.05.5-1. <br /> <br />XIII. Protection of Fish, Wildlife and Related Environmental Values <br /> <br />Wildlife investigations have previously been conducted within, or immediately adjacent <br />to the NHN permit area. The extent of these investigations is shown on Map 2.04.11-1 <br />of the permit. Peabody commissioned a wildlife investigation for the Nucla Mine in <br />1979-1980 (Appendix 2.04.11-1). With this study, Mariah and Associates determined <br />that there were 53 species of mammals, 109 species of avifauna, and 20 species of <br />amphibians and reptiles that were observed or could potentially occur in the area. <br />Threatened and Endangered Species surveys performed in connection with the 1978- <br />1980 wildlife investigations revealed that five species could potentially occur in the <br />project area: American Peregrine falcon, Northern Bald eagle, Whooping crane, Black- <br />footed ferret, and Gray wolf.
