<br /> <br /> <br /> 27 <br />Irrigated Pasture (IP) – The success standard for reclaimed Irrigated Pasture is based <br />on comparison to the Irrigated Pasture Reference area. Successful cover and <br />production will be demonstrated by a statistically valid demonstration of reclaimed <br />area/reference area comparability in accordance with applicable requirements of Rule <br />4.15 and as described under Irrigated Pastureland Success Criteria and Statistical <br />Procedures beginning on page 17 of Section 2.05.4(2)(e) in the permit application. <br />In lieu of a species diversity standard, a forage quality standard will be implemented <br />that is outlined in Section 2.05.4(2)(e) page 17. A woody stem density is not required <br />for revegetation success (4.15.8(7)). <br /> <br />Dryland Pasture (DP) – The success standard for reclaimed Dryland Pasture is based <br />on comparison to a Dryland Pasture Reference area. Successful cover and production <br />will be demonstrated by statistically valid demonstration of reclaimed area/reference <br />area comparability in accordance with applicable requirements of Rule 4.15 and as <br />described under Dryland Pastureland Success Criteria and Statistical Procedures <br />beginning on page 25 of Section 2.05.4(2)(e) of the permit application. In lieu of a <br />species diversity standard, a forage quality standard will be implemented that is <br />outlined in Section 2.05.4(2)(e) page 30. A woody stem density is not required for <br />revegetation success (4.15.8(7)). <br /> <br />F. The Division proposes to approve of the reference areas which the applicant has <br />selected based on the requirements of Rule 4.15.7(3). The operator owns and <br />manages the Irrigated Pasture reference area which is located south of the New <br />Horizon Mine office. The operator also owns the Dry Land reference area which is <br />also known as the Old Peabody Sage Reference Area located between the New <br />Horizon Mine and the New Horizon North Mine. This reference area is fenced <br />protecting it from domestic livestock. The Intensely Managed Irrigated Pasture will <br />use a Historic Record reference for a final revegetation success standard. This <br />standard is based on three years of data collected prior to any mining disturbance. <br /> <br />G. The reference areas will be utilized to determine revegetation success in a manner <br />which the Division finds acceptable 4.15.7(4)). <br /> <br />H. All of the lands in the New Horizon North Mine area are under private ownership <br />and fish and wildlife or combination rangeland/fish and wildlife habitat are not a post <br />mining land use. Therefore, a woody stem density standard is not required for <br />revegetation success (4.15.8(7)). <br /> <br />XII. Post-mining Land Use <br /> <br />The Division is proposing to approve alternative post-mining land uses. The land uses <br />meet the criteria of Rule 4.16.3. Pre-mining land use appears on Map 2.04.3 and is <br />described in Section 2.04.3 of the permit. Maps 2.05.5-1 and 2.05.5-2 illustrate the <br />proposed post-mining land uses, and supplement the written material of Section 2.05.5. <br />The reclaimed lands will be capable of supporting the uses which they were capable of <br />supporting before any mining, or reclaimed to higher or better uses achievable under
