Given the distance involved between the <br />probable occurrence of known alluvial valley floors and NHN, the Division confirms the <br />negative presence of alluvial valley floors in the mine area. The results of the AVF <br />investigation are in Section 2.06.8 of the permit document. <br /> <br />13. The Division proposes to re-approve the post-mining land uses of irrigated pasture, intensel y <br />m anaged irrigated pasture and d ryland p asture. These land uses meet the requirements <br />of Rule 4.16 for the permit area (2.07.6(2)(l)). <br /> <br />14. The Division finds that no specific approvals required under Rule 4 are necessary for this <br />mine plan. <br /> <br />15. The Division finds that the activities by the applicant would not affect the continued <br />existence of endangered or threatened species or result in the destruction or adverse <br />modification of their critical habitats (2.07.6(2)(n)). <br /> <br />16. The Division has contacted the Office of Surface Mining, Reclamation Fees Branch. As of <br />this time, Elk Ridge Mining and Reclamation, LLC, the present operator, is current in the <br />payment of reclamation fees required by 30 CFR Chapter VII, subchapter R (2.07.6(2)(o)). <br /> <br />Section B - Rule 4 <br /> <br />I. Roads - Rule 4.03 <br /> <br /> A. Haul Roads <br /> <br />Haul Roads are described in Section 2 .05 .3(3) and detailed on Map 2.05 .3(3)-3 of <br />the permit application. The West Haul Road and North Haul Road range in width <br />from 30 to 100 feet and are located entirely within the bounds of the disturbed area <br />in accordance with 4.05 .2(4). Drainage from the haul roads is directed to sediment <br />ponds within the permit boundary using a system of ditches and culverts, thus <br />preventing additional contributions of suspended solids to streamflow or to runoff <br />outside the permit area. The roads are surfaced with gravel and prudent dust control <br />practices are used as necessary. No haul roads will be retained as permanent <br />features. <br /> <br /> B. Access Roads <br /> <br />The South Access Road is described in Section 2.05.3(3) and detailed on Map <br />2.05.3(3)-3 of the permit application. The road ranges in width from 20 to 60 feet <br />and is located entirely within the bounds of the disturbed area in accordance with <br />4.05.2(4) and will not be used for the transport of coal, spoil or coal mine waste . <br />Drainage from the access road is directed to sedimentation ponds within the permit <br />boundary using a system of ditches and culverts, thus preventing additional <br />contributions of suspended solids to streamflow or to runoff outside the permit area. <br />The road is surfaced with gravel, rock or other material approved by the Division.
