14. Approvals <br />Specific approvals have been granted or are proposed. These approvals are addressed in Section <br />B below [Rule 2.07.6(2)(m)]. <br />15. Threatened and Endangered Species <br />The Division finds that the current and proposed activities at the Keenesburg Strip Mine will not <br />affect the continued existence of endangered or threatened species or result in the destruction or <br />adverse modification of their critical habitats [Rule 2.07.6(2)(n)]. <br />16. Reclamation Fees <br />The Division has contacted the Reclamation Fees Branch within the Office of Surface Mining <br />and determined that CEC is current in the payment of reclamation fees required by the Code of <br />Federal Regulations (30 CFR, Chapter VII, subchapter R) [Rule 2.07.6(2)(0)]. <br />Section B - Rule 4 <br />The PAP for the Keenesburg Mine does not have section names that correspond to Section 4 of <br />the Rules. However, the operations plan, found under Section 2.05.3 of the PAP, contains the <br />necessary information as discussed below. <br />I. Rule 4.01 General Provisions <br />The Division finds that performance standards and design requirements of the (renewed) permit <br />will provide for the scope and objectives of general provisions of Rule 4.01. <br />II. Rule 4.02 Signs and Markers <br />Signs and appropriate permit markers are erected and in place at the site. An entrance sign in <br />compliance with Rule 4.02 is in place, as are topsoil (topsand) pile signs. <br />III. Rule 4.03 Roads <br />I FMR0.176=60 <br />Hauling of coal, spoil, and coal mine waste has been terminated at the Keenesburg Mine, and <br />there are no plans to resume these activities. Ash importation into the mine ceased in April <br />2016. Haul roads at the site have been re-classified as Access Roads [Rule 4.03.1]. <br />Access Roads <br />Access roads have been designed, constructed, and certified by a registered professional engineer <br />[Rule 4.03.2(1)(d)]. <br />13 <br />
