2. Proposed Decision <br />The Colorado Division of Reclamation, Mining and Safety proposes to approve an application <br />for permit renewal. <br />The application was submitted by Coors Energy Company for the mine. This decision is based <br />on a finding that the operations will comply with all requirements of the Colorado State Program <br />as found in the Colorado Surface Coal Mining Reclamation Act, C.R.S. 34-33-101 et seq., and <br />the Regulations promulgated pursuant to the Act. If no request for a formal hearing is made <br />within thirty (30) days of the first publication of the issuance of this proposed decision, then this <br />decision becomes final. Upon submittal of acceptable surety by the applicant, the permit will be <br />issued. The permit application, all supporting documentation and any stipulations or conditions <br />will become a binding part of the permit. <br />3. Summary <br />3.1 The Review Process <br />3.1.1 Initiation of Renewal <br />The Division of Reclamation, Mining and Safety (Division) notified the Coors Energy Company <br />(CEC) on January 12th, 2016 that the existing Permit for the Keenesburg Mine would expire on <br />October 14, 2016. CEC responded on April 06, 2016 with an application for permit renewal. <br />The Division deemed the Application complete on April 14, 2016. <br />3.1.2 Public Notice <br />Public notice of submittal of the Application was published four times in The Fort Lupton Press <br />between May 3, 2016 and May 25, 2017. Notice that the Application was considered complete <br />for the purposes of filing was provided by the Division, in accordance with Title 34, Article 33, <br />Section 118, Paragraph 3, of the Colorado Revised Statutes. <br />3.1.3 Application Reviews and Responses <br />The Application was reviewed for adequacy, and the Division identified six items requiring <br />update or clarification in a letter to CEC (dated June 13, 2016). CEC provided acceptable <br />responses to all items in multiple submissions including working with the division to resolve <br />acreage discrepancies resolved in Technical Revision 46 issued on November 22, 2016. <br />3.1.4 Status of Permit Stipulations <br />There are no stipulations on this permit at this time.
