The inspection was accompanied by Jason
Tuttle of BME. The longwall continues in panel LW-B14 near County Road 65 and no coal trains were observed
at the time of the inspection. Currently, no revisions are under review by the Division.

HYDROLOGIC BALANCE - Rule 4.05 Drainage Control 4.05.1, 4.05.2, 4.05.3; Siltation Structures 4.05.5,
4.05.6; Discharge Structures 4.05.7, 4.05.10; Diversions 4.05.4; Effluent Limits 4.05.2; Ground Water
Monitoring 4.05.13; Surface Water Monitoring 4.05.13; Drainage – Acid and Toxic Materials 4.05.8;
Impoundments 4.05.6, 4.05.9; Stream Buffer Zones 4.05.18:

The D-Seam dewatering pond system #2 ponds 5A, 3 and 4 of the Phase I construction have been completed, with
the exception of the discharge and flume of the finishing Pond 4. The ponds have been completed as designed with
the exception of slight modifications associated with Pond 5A. These modifications should be noted in as-built
designs submitted with a Technical Revision to the permit. The modifications observed should not have an
impact on the outflow design or a major deviation of the holding capacity of the pond. A small seep was observed
on the west embankment of pond 5A. This area should be monitored to ensure that the integrity of the
embankment is not compromised.
