HISTORY <br />August 8, 2017 <br />Christine Belka <br />Senior Regulatory Program Specialist <br />USDOI Office of Surface Mining <br />Reclamation and Enforcement <br />Denver Field Division <br />1999 Broadway, Suite 3320 <br />Denver, Colorado 80202 <br />Re: Colowyo Mine, Collom Expansion Post -Review Discovery (HC #69522) <br />Dear Ms. Belka: <br />Thank you for your email correspondence dated August 7, 2017 requesting our review and comment on the report titled <br />A Cultural Resource Historic Properties Treatment Plan for site BK -9-072697 as part of the Colomyo Coal Company's Collom Mine <br />Expansion Project, Moffat County, Colorado. We understand that this mitigation is proposed by the Office of Surface Mining <br />Reclamation and Enforcement (OSMRE) to address adverse effects associated with a post -review discovery to historic <br />property BK -1-072617. <br />We find the historic property treatment plan to be thorough and comprehensive and we commend the contractor for a <br />job well-done. Our comments are minor. In the event of an unmarked burial discovery, we believe that consultation <br />should follow Colorado Revised Statute 24-80-1301 et seq, rather than NAGPRA, as we understand the project is located <br />on private land. Minor revision is needed within Section 3.3.6 (last sentence) to replace NAGPRA with appropriate <br />reference to Colorado's unmarked human graves law. And while we do not object to the evaluative testing memorandum <br />or preliminary data recovery results report, as proposed, we do request that you provide a timeline for when the final data <br />recovery technical report will be completed. <br />Please let us know if we may provide additional comment or clarification. Additional information provided by Indian <br />tribes or other consulting parties may cause our office to re-evaluate our recommendations. We thank you for the <br />opportunity to comment and we look forward further consultation on OSMRE's proposed actions.
