<br />Dear Mr. Burdick and Mr. Vasquez:
<br />On July 21, 2017, Notice of Violation MV -2017-028 was issued to Permit M-1987-092 for failure
<br />to submit the annual report, which was due August 25, 2016. The corrective actions, whereby
<br />the violation may be resolved, required the submittal of the delinquent annual report and
<br />payment of $323 civil penalty. On August 9, 2017 the Division received the delinquent annual
<br />report. However, the Division has not received the $323 civil penalty.
<br />Therefore, the enforcement hearing scheduled for August 23, 2017, remains on the agenda of
<br />the Mined land Reclamation Board (Board). During the Board hearing on August 23, 2017, the
<br />Board will consider revocation of the permit and finding the financial warranty subject to
<br />forfeiture for failure to comply with Violation MV -2017-028.
<br />If the Division receives full payment for the $323 civil penalty, no later than August 21, 2017,
<br />the Division will withdraw the matter from the Board's agenda and the hearing will be vacated.
<br />Otherwise, the formal Board hearing will occur on August 23, 2017, as previously indicated in
<br />the Division's correspondence dated July 21, 2017.
