Heit Pit SWSP Page 3 of 5 <br />August 8, 2017 <br /> <br />approximately 15% (3.04 acre-feet) will be lost during transit, based on a transit loss of 0.5% per <br />mile for the 29.75 miles from the Broomfield wastewater treatment plant to the Heit Sand and <br />Gravel Mine. The amount of Broomfield replacement water that reaches the Heit Sand and Gravel <br />Mine is 17.42 acre-feet, which is sufficient to cover the projected lagged evaporative and <br />operational depletions for this plan period. These transit loss amounts are subject to review and <br />modification by the division engineer or water commissioner. If a different transit loss is <br />determined by the division engineer or water commissioner the Applicant must modify their <br />accounting and replacements, as necessary, to be consistent with the determined transit loss. The <br />monthly depletions and replacement deliveries are found on the attached Table 3. <br />Conditions of Approval <br /> I hereby approve the proposed substitute water supply plan in accordance with §37-90- <br />137(11), C.R.S., subject to the following conditions: <br />1. This plan shall be valid for the period of September 1, 2017 through August 31, 2018, unless <br />otherwise revoked or superseded by a decree. If this plan will not be made absolute by a <br />water court action by the plan’s expiration date, a renewal request must be submitted to <br />this office with the statutory fee of $257 no later than June 30, 2018. <br />2. A well permit has been obtained for the current use and exposed pond surface area of the <br />gravel pit in accordance with §37-90-137(2) and (11), C.R.S., permit no. 62970-F. <br />3. Well permit no. 66319-F was approved pursuant to §37-90-137(2), C.R.S., for the proposed <br />operational uses. <br />4. Approval of this SWSP is for the purposes stated herein and pumping is limited to the wells <br />identified above. Additional wells and/or additional uses for the water that is the subject <br />of this SWSP will be allowed only if a new SWSP is approved for those additional wells/uses. <br />5. The total surface area of the ground water exposed must not exceed 2.0 acres, which results <br />in a maximum evaporative annual loss at the Heit Sand and Gravel Mine of 5.82 acre-feet. <br />6. The annual amounts of water used at the Heit Sand and Gravel Mine shall not exceed 1.0 acre- <br />feet for dust control, and the total amount of aggregate washed shall not exceed 485,000 tons <br />per year, resulting in a consumptive use of 10.7 acre-feet of water. The annual amount of <br />water used at the site for operational purposes therefore shall not exceed 11.7 acre-feet. <br />7. Total consumption at the Heit Sand and Gravel Mine must not exceed the aforementioned <br />amounts unless an amendment is made to this plan. <br />8. Approval of this plan is for the purposes as stated herein. This office must first approve any <br />additional uses for the water. <br />9. All releases of replacement water must be sufficient to cover all out-of-priority depletions <br />in time, place, and amount and must be made under the direction and/or the approval of <br />the water commissioner. The release of replacement water may be aggregated to maximize <br />beneficial use. The water commissioner and/or the division engineer shall determine the <br />rate and timing of an aggregated release. <br />10. The replacement water that is the subject of this plan cannot be sold or leased to any other <br />entity. As a condition of subsequent renewals of this substitute water supply plan, the <br />replacement water must be appurtenant to this site until a plan for augmentation is <br />obtained.
