<br />We have received the letter dated August 18
<br />16, 2017 requesting the renewal of the above referenced substitute water supply plan (“SWSP”) to
<br />cover depletions caused by an existing gravel mining
<br />accordance with § 37-90-137(11), C.R.S.
<br />received (receipt no. 3676018). This SWSP has been most recently approved on September 22, 2015
<br />for the period of September 1, 2015 through August 31, 2016. An SWSP approval for the period of
<br />September 1, 2015 through August 31
<br />with the City of Broomfield for that period was not provided.
<br />Plan Operation
<br />The Heit Sand and Gravel Mine perimeter
<br />Engineer’s Lining Criteria, and was approved by the Division Office on June 24, 2009. In accordance
<br />with paragraph 21 of the General Guidelines for Substitute Water Supply Plans for Sand and Gravel
<br />Pits, the applicant is required to provide replacement for all native ground water remaining within
<br />the lined area that is put to beneficial use except for the water removed with the mined product.
<br />The water may be removed from within the lined area and
<br />surface flow or ground water recharge without need for replacement, so long as the operator does
<br />not put the water to beneficial use. Replacement shall be made for native ground water that is
<br />lost to evaporation. For purposes of this SWSP, it is assumed that all water within the lined area is
<br />trapped native ground water. Therefore, this plan will account for depletions resulting from
<br />evaporation of exposed water within the lined area. Operational depletions at the si
<br />of water used for dust control and for washing of the mined aggregate using an onsite production
<br />well. All water used from the production well must be replaced in time, place and amount
<br />including water used for washing of mined product.

<br />3676018). This SWSP has been most recently approved on September 22, 2015
<br />for the period of September 1, 2015 through August 31, 2016. An SWSP approval for the period of
<br />September 1, 2015 through August 31, 2016 was not granted because a copy of the extended lease
<br />with the City of Broomfield for that period was not provided.
