EXHIBIT S —• PERMANENT MAN-MADE STRUCTURES <br /> The information provided in this Exhibit is intended to satisfy the requirements outlined in Section <br /> 6.4.19 of the Colorado Mined Land Reclamation Board Construction Material Rules and <br /> Regulations. <br /> Where mining will adversely affect the stability of any significant, valuable or permanent <br /> man-made structure located within 200 feet of affected land, the applicant may either: <br /> a) Provide a notarized agreement between the applicant and the person(s)having <br /> an interest in the structure, that the applicant is to provide compensation for any <br /> damage to the structure;or <br /> Please refer to the attached engineering stability analysis <br /> b) The applicant shall provide an appropriate engineering evaluation that <br /> demonstrates that such structure shall not be damaged by activities occurring <br /> at the mining operation. <br /> The attached engineering stability analysis for the mining operation considered the <br /> following permanent man-made structures within 200 feet of the affected land boundary <br /> that are owned by others: <br /> Weld County P " i Gas Well, Pipe and <br /> "vel y, Colorado \Appurtenances <br /> • <br /> Weld County - 1/2 Bataa Oil, Inc. <br /> \Wel y,Colorado <br /> Water Line <br /> Weld County Ro., Baseline Mountain View Water Users <br /> Road/1•: • 4 ve Sakata Farms waterline <br /> - • County,Colorado <br /> Residence/Outbuildings/Fences <br /> Tucson S Vag& Robert Parker <br /> W ounty,Colorado Jhady Kirkpatrick <br /> Jose& Maria Lujan <br /> Telephone Line and Pedestals <br /> Qwest Inc.
