Ms. Megan Sullivan <br />February 14, 2012 <br />Page 3 <br />600 -Ft Well Spacing Issues <br />We researched and identified existing well permits within 600 feet of the planned mine <br />excavation areas and New Horizon Mine Pond No. 12. Wells within 600 feet of the mine <br />excavation areas are described in the attached Tables 1 and 2, and are shown on Figures 1 <br />and 2. Wells within 600 feet of the planned mine excavation areas were identified for <br />both the New Horizon 2 Mine and the New Horizon North Mine. Western Fuels is <br />working to confirm the locations of these wells and will work with the well owners to <br />seek 600 -ft. spacing waivers if it is determined that there are production wells with valid <br />well permits within 600 feet of the mine excavation areas. <br />There are some wells that Western Fuels has leased or is in the process of purchasing. <br />Because Western Fuels controls or will control those wells, we are not intending to seek <br />600 foot spacing waivers for those wells, as summarized in the attached tables. <br />Various monitoring wells were identified and we are not intending to seek 600 foot <br />spacing waivers for monitoring wells. There were no wells identified within 600 feet of <br />the New Horizon Mine Pond No. 12. <br />Future Well Permits <br />Western Fuels will apply for additional well permits in the future, as needed, under the <br />SWSP and pending cases. Future well permits may be needed for potable water supply <br />wells at New Horizon North Mine, additional ponds, and other structures included in the <br />pending cases and SWSP. <br />In addition to the well permit applications and the supporting information attached, we <br />have attached a check in the amount of $300 to cover the permit application fees for the <br />three well permits. We will contact your office within the next three business days to <br />coordinate any necessary correspondence regarding the 600 foot spacing waivers.
