February 8, 2013 <br />Division of Water Resources <br />1313 Sherman St, Room 821 <br />Denver, CO 80203 <br />RE: Well permit applications for Western Fuels - Colorado LLC, Receipt Nos. <br />3654112A through 3654112C <br />'ro whom it may concern: <br />I have field- located the following wells, which were identified to be potentially located <br />within 600 -feel of Western Fuels- Colorado LLC's (WFC) planned mining area. I located <br />the wells using; survey equipment and determined the following: <br />• Well Permit No. 186113 is less than 600 feet from the mining excavation area of <br />the New Horizon North mining area as proposed in the original permit applications. WFC <br />will set back their mining area such that the mining excavation is more than 600 feet from <br />this well. <br />• Well Permit No. 47673 is less than 600 feet from the mining excavation area as <br />proposed in the original permit applications. WFC will set back their mining area such <br />that the mining excavation is more than 600 feet from this well. <br />• Well Permit No. 18275 is more than 600 feet from WFC's New Horizon 2 mining <br />excavation area. <br />I have reviewed the updated mapping provided by Bishop- Brogden Associates, Inc. and <br />confirm that the new actual excavation areas shown on their maps are more than 600 feet <br />from these three wells. <br />Best Re aids, L <br />Ross L.
