Therefore, the 0.8 requirement for thin overburden and the 1.2 requirement for thick overburden are not met. Disposal of Excess Spoil: All excavated non -coal material from the mining areas will be used for backfilling the mined pits and blending mined areas into the existing topography to achieve the approximate original landform. Therefore, no excess spoil material will exist. Post -Mining Topography: Mining operations will be performed with shovel/truck and dozers at NHN Mine. The post -mining topography was estimated based upon a 15 percent swell factor. Map 2.05.4-1 shows the post -mining topography which is similar to the existing topography. Cross-section locations and typical cross-sections through the mining areas are also shown on this map. These cross sections show original and post -mining ground elevations. Slides and Other Damage: NHN does not anticipate any problems with slides at mine during the term of mining and reclamation activities. Post -Mining Drainage Channels: Three primary drainage channels pass through the NHN Mine area. Glasier Draw, Meehan Draw and Nygren Draw (See Map 2.04.7-1). No mining will occur in these drainage channels. However, the North Haul Road is approved to cross Meehan Draw as shown on Map 2.05.3(3)-3. The disturbance to this wetland area will be mitigated as described in NHN's Nationwide General Permit No. 21 - Surface Coal Mining Activities (Section 404) from the U.S. Army Corp of Engineers. A copy of the approved Section 404 permit is on file at the New Horizon Mine office and available for review at the Division's request. Heavy equipment working in wetlands must be placed on mats, or other measures must be taken to minimize soil disturbance. Appropriate soil erosion and sediment controls must be used and maintained in effective operating condition during construction, and all exposed soil and other fills, as well as any work below the ordinary high water mark, must be permanently stabilized at the earliest practicable date. Permittees are encouraged to perform work during periods of low -flow or no -flow. Temporary fills must be removed in their entirety and the affected areas returned to pre - construction elevations. The affected areas must be vegetated, as appropriate. Any authorized structure or fill will be properly maintained, including maintenance to ensure public safety and compliance with applicable NWP general conditions, as well as any activity - specific conditions added by the district engineer to a NWP authorization.
