New Horizon Mine <br />I. General <br />Elk Ridge Mining and Reclamation LLC., New Horizon Mine, Permit No. C-1981-008, is <br />submitting this application for Phase II and III performance bond release. New Horizon is <br />requesting that a total of 2.0 acres be Phase II and III released with this application. The current <br />bond amount for the New Horizon Mine is $5,227,008, and New Horizon Mine currently holds a <br />self -bond in the amount of $5,300,000. With this application, the New Horizon Mine will be <br />requesting relinquishment of 100% of the bond held for these parcel. <br />II. Summary Information <br />A. General Location Description <br />The 2.0 acres requested for Phase II and III release is located within Montrose County, Colorado, <br />in the following general locations: <br />NW I/ SW'/ of Section 31, Township 47 North, Range 15 West of the 6rh P.M. <br />Please see Map 1 for exact locations applied for in this application. <br />B. Public Notice <br />Pursuant to the Rules and Regulation of the Colorado Mined Land Reclamation Board published <br />August 1980, and pursuant to the Colorado Surface Coal Mining Reclamation Act 34-33-101, et <br />seq., notice is hereby given of the filing of an application for Phase II and III Bond Release of a <br />portion of the New Horizon Mine site. The application is denoted as SL -20 and pertains to the <br />New Horizon Mine, Permit No. C-1981-008 (approved April 6, 1983) by Elk Ridge Mining and <br />Reclamation, LLC, P. O. Box 628, Nucla, Colorado 81424, filed with the Colorado Division of <br />Reclamation, Mining and Safety (CDRMS), Colorado Department of Natural Resources, 1313 <br />Sherman Street, Room 215, Denver, Colorado 80203. The New Horizon Mine is located <br />approximately 2 miles west of Nucla, Colorado. <br />The Phase II and III bond release areas applied for is a portion of the BB Detour Road that is <br />being retained as a permanent feature. The surrounding area was reclaimed in 2009. This area <br />includes approximately 2.0 acres and in shown in detail on Map 1 within the application. The <br />status of the areas being applied for is consistent with the requirements of the approved <br />reclamation plan which includes achievement of Phase I, and retention of a portion of the BB <br />Detour Road as a permanent feature in the post mine topography.
