JUL 2.8 �o <br />Permit No. C-1981-019 WSION OF RECLAMATION <br />Cultural Resource Discovery MINING AND SAFETY <br />Dear Mr. Trujillo: <br />Tri-State Generation and Transmission Association Inc. (Tri-State), is the parent <br />company to Axial Basin Coal Company, which is the general partner to Colowyo Coal Company <br />L.P. (Colowyo). Colowyo operates under the Division of Reclamation, Mining, and Safety <br />(Division) Permit No. C 1981-019. <br />In accordance with Exhibit 5 Item 3 of the permit to mine, Tri-State on behalf of <br />Colowyo is providing written notification to the Division of the discovery of two cultural <br />resources sites. As required, a Colorado permitted archaeologist has evaluated both of the <br />discoveries and has made a recommendation to the eligibility of the sites to the National Register <br />of Historic Places (NRHP). This documentation and recommendation has been included for your <br />review. <br />One site is located outside of the disturbance boundary where it will not be impacted by <br />mining related activities, and per the enclosed documentation is not recommended as an eligible <br />site for the NRNP. The other cultural site was discovered during topsoil removal activities, and <br />all mining related activities have ceased for 100 foot around the site as required. It has been <br />recommended as an eligible site for the NRNP. Both sites discovered reside on Colowyo's <br />private deeded property. <br />Tri-State and Colowyo are fully committed to protecting all cultural resources sites, and <br />will take the measures required to ensure the sites are mitigated or avoided.
