HISTORY <br />August 2, 2017 <br />Jeremy Iliff <br />Archaeologist, Indian Programs Branch, Program Support Division, Western Region <br />Office of Surface Mining Reclamation and Enforcement <br />1999 Broadway St, Ste 3320 <br />Denver, Colorado 80202 <br />Re: Colowyo Mine, Collom Expansion Post -Review Discovery (HC #69522) <br />Dear Mr. Iliff: <br />On August 1, 2017 we received your email notification of post -review discoveries associated with Colowyo Mine's <br />Collom Expansion project in accordance with 36 CFR 800.13(b)(3). This documentation indicates the project is an <br />undertaking, as defined by 36 CFR 800.16(y), and that discoveries occurred during construction of an expansion haul <br />road. <br />Following our review of the notification package, we understand that the Office of Surface Mining Reclamation and <br />Enforcement (OSMRE) recommends archaeological site (designated BK -1-072617) eligible for listing to the National <br />Register of Historic Places (NRHP) with a second property (designated BK -1-072117) not eligible. Considering the <br />information provided to our office, the Colorado SHPO concurs with OSMRE's determination that site BK -1-072617 is <br />eligible for listing to the NRHP under criterion D and BK -1-072117 is not eligible under any criteria. With regards to the <br />proposed actions to resolve adverse effects, we find OSMRE's proposal to define the horizontal and vertical boundaries <br />of BK -1-072617 appropriate as we do its recommendation to complete data recovery of affected features/deposits. In <br />addition to the proposed work, we recommend OSMRE and its consulting parties consider ways to avoid or minimize <br />additional effects to this historic property, specifically and particularly to any archaeological features and/or cultural <br />horizons that may exist exterior to the current disturbance. As work schedules allow, we anticipate that we will be given <br />an opportunity to review and comment on the pending treatment plan. <br />Our final comment is intended to address your question regarding whether consultation should occur under the National <br />Historic Preservation Act or the Colorado State Register Act. It is our opinion that consultation for all federal <br />undertakings should follow Section 106 of the National Historic Preservation Act and we look forward to consulting <br />pursuant to 36 CFR 800, the implementing regulations of Section 106 of the National Historic Preservation Act, for all <br />OSMRE undertakings. <br />Additional information provided by Indian tribes or other consulting parties may cause our office to re-evaluate our <br />recommendations.
