The purpose of this inspection was to evaluate the on-the-ground condition with <br />respect to the Yoast Mine’s Phase I and III bond release application, SL-06 in accordance with Rule 3.03.2(2). <br />Jerry Nettleton and Miranda Blomquist of Peabody Energy accompanied the inspection. Jennifer Maiolo and <br />Christine Belka accompanied the inspection, representing the BLM and OSM respecfully. The inspection was <br />also attended by Gary Valora, an adjacent landowner. Mr. Valora was also in attendance to represent landowner <br />John Patrick. The weather was clear and the ground was dry during the inspection. All areas to be inspected were <br />accessible and visible. <br /> <br />Lands requested for liability release under SL-06 include 94.9 acres of Phase I lands and 277.2 acres of Phase III <br />lands reclaimed beginning in 1997 and through 2007. Surface land ownership of the bond release area is private <br />and Federal and Mineral ownership is private and Federal. <br />BACKFILL and GRADING – Rule 4.14 Contemporaneous Reclamation 4.14.1; Approximate Original Contour <br />4.14.2; Highwall Elimination 4.14.1(2)(f); Steep Slopes 4.14.2, 4.27; Handling of Acid and Toxic Materials <br />4.14.3; Stabilization of Rills and Gullies 4.14.6: <br /> <br />The majority of the SL-6 Phase I bond release areas were included in previous bond release applications and were <br />either excluded from the submittals or rescinded back to Phase I status due to slope instabilities. Backfilling and <br />grading of the Yoast Mine was conducted between 1997 and 2007. Cross sections of the Phase I areas were <br />submitted with the SL-6 application. All backfilling and regraded areas of the Phase I bond release showed no <br />substantial deviations from the approved post mining topography during the on-the-ground inspection. Slopes <br />within the Phase I areas were stable with no evidence of instability or erosion at the time of the inspection. <br /> <br />The YPM-20 drainage area, identified as Phase I parcels 8, 12, and 14, was rescinded on 2012 as a part of the SL-4 <br />application due to a slide. In addition, the Pond 013 slide area, identified as parcel 3, is an area that was damaged <br />due to a slide. Parcels 8, 12, 14, and 3 were approved by the Division in TR-51 to be remediated. As a part of the <br />remediation, the slumped area of the slides were to remain in place with regrading of the head scarp of the areas.
