PERMIT#: M-2008-082 <br /> INSPECTOR'S INITIALS: ECS <br /> INSPECTION DATE: August 1,2017 <br /> After the inspection of the permit area, DRMS and permittee representatives approached the residents of the <br /> Ruiz family to observe the dried pond area and gather additional information. During conversations with the <br /> Ruiz family, they acknowledged that they do not hold any water rights for the pond, and agreed to work with <br /> the mine to allow a surveyor on site to collect elevation data for the pond floor and outlet culvert. They <br /> expressed concern that the drying of the pond would have an adverse impact on the local wildlife that they <br /> had observed in and around the pond (carp, catfish, turtles, raccoons, birds, etc.). A friend of the family that <br /> was present during the inspection stated that they had contacted Colorado Department of Wildlife earlier in <br /> the year in an attempt to relocate the fish and turtles when the pond was drying out, but that CDOW did not <br /> express interest. <br /> In summary: <br /> • The sources of water in the pond appear to be limited and seasonal surface flow from upstream <br /> wetlands, precipitation, and storm drainage; <br /> • the pond in question historically shows large fluctuations in size and feeds the Holton Seep Ditch; <br /> • The permittee has demonstrated that they hold the water rights associated with the Holton Seep <br /> which may include the pond in question; <br /> • None of the underlying or surrounding property owners appear to hold any water rights on the pond or <br /> associated drainage. <br /> Therefore, DRMS has insufficient evidence at this time to pursue enforcement action against the permittee. <br /> DRMS will, however, continue to gather information and monitor the situation.
