Everist, Incorporated (Permittee/Operator) respectfully requests an Acreage Reduction (Partial
Release) of the permit covering the Star Water Resource, M-1977-522. Please see the completed and
attached Division of Reclamation, Mining and Safety's form - Request for Full or Partial Release of
Permit Area/Surety Reduction. Also attached is the Star Water Resource's Map Exhibit F -
Reclamation Plan Map (As-Built).
The total permitted acreage of the Star Water Resource is 81.27 acres. L.G. Everist is requesting
release of 61.07 acres. This would result in a remaining permit area of 20.1 permitted acres.
Area to be Released (61.07 acres)
The 61.07 acres we are requesting to be released have been fully reclaimed. The permitted areas in
general include: (a) the West Lake (lined and certified water storage reservoir) and surrounding land
on the west side of the site, (b) the west (b) part of the parking area in the south-middle section of the
site, and (c) the fully vegetated areas on the north and east sides of the East Lake (except for a 50-foot
setback around those sides of the East Lake). For complete boundary details, please refer to the
attached Map Exhibit F - Reclamation Plan Map (As-Built), which shows the new permit area (20.1
acres remaining in permit) outlined in green.
In July, 2015, the Division approved of the substantial reclamation of Star Water Resource, which
included the approval and certification of the liner around the West Lake by the Colorado Division of
Water Resources, and resulted in a Financial Warranty reduction. However, no permitted acreage was
fully released, due to the vegetation on the site not being acceptable to the Division.
Over the past two years, L.G. Everist has focused on revegetation work and weed management of the
Star Water Resource, so that we would achieve the vegetation reclamation requirements. And now,
the vast majority of the vegetated areas show substantial overall improvement in revegetation thickness
and quality since the Division's last inspection(Aug-2016).
L.G. Everist hired contractors to help us achieve the required level of self-regenerating vegetation of
approved grass species in those areas of Star's Reclamation Plan that are vegetated. And now,
revegetation in the areas to be released has reached a required and approvable level as described in
the Division's Rules. We have attached a sampling of invoices showing re-seeding and continued
