6.A. Historical Type and Place of Use: The Subject Water Rights were <br />historically used as the sole source of water for flood irrigation of approximately 28 <br />acres located in the SEI/4 NEI/4, Section 31 and the SW1/4 NW1/4, Section 32 all <br />in Township 33 North, Range 9 East, NMPM ("Historically Irrigated Land"). The <br />Subject Water Rights were part of a larger share pool owned and used by the former <br />owner. Alfalfa and pasture grass were the primary crops grown. <br />6.13. Historical Season of Use: Water was typically diverted through the Canon <br />Irrigating Ditch for irrigation from April 1 through November 1. Many diversion <br />seasons were shorter due to limded availability in the Conejos River. <br />6.C. Historical Diversions: Between 1968 and 2013, Canon Irrigating Ditch river <br />headgate diversions averaged 5,158 acre-feet per year, with a maximum annual <br />diversion of 7,996 acre-feet and a minimum annual diversion of 237 acre-feet. The <br />Subject Water Rights' pro -rata share of the river headgate diversions averaged 86 <br />acre-feet per year, with maximum annual diversion of 133.3 acre-feet and a <br />minimum annual diversion of 3.9 acre-feet. It is assumed that approximately 50% of <br />the water diverted at the river headgate under the Subject Water Rights was lost to <br />ditch seepage. Using that assumption, farm headgate deliveries of the Subject <br />Water Rights averaged 43 acre-feet per year, with a maximum annual farm <br />headgate delivery of 66.6 acre-feet and a minimum annual farm headgate delivery of <br />2.0 acre-feet. <br />6.D. Historical Consumptive Use: It is also assumed that 50% of farm headgate <br />deliveries were consumed by crops and 50% returned to the river as surface or <br />ground water return flow. <br />7. Description of Change of Use: The Applicants seek to change the type and <br />place of use of the Subject Water Rights from irrigation and domestic to <br />augmentation of commercial / industrial well(s) by means of recharge. The <br />Applicants seek to change the place of use of the Subject Water Rights to allow <br />diversion of the Subject Water Rights from the Canon Irrigating Ditch into a recharge <br />pond located within the SW1/4 NE1/4 Section 31, Township 33 North, Range 9 East, <br />NMPM in order to augment withdrawals from Well No. Aug. 1 located in the NW% <br />NW'/4 of Section 32, Township 33 North, Range 9 East, NMPM, at a point <br />approximately 875 feet from the North Section Line and 203 feet from the West <br />Section Line, in Conejos County, Colorado, UTM NAD83 Zone 13S 409422 mE and <br />4102251 mN. <br />8. Dry -Up of Historically Irrigated Land: The Historically Irrigated Land shall be <br />permanently removed from irrigation and monumented and/or fenced in a manner <br />acceptable to the Division Engineer.
