Cotten, P.E. <br />Division Engineer <br />Re: Use of Well No. 2, Case No. W-953 -- Randall Robins <br />Well located within the SW% Section 29, T33N, R9E, NMPM <br />Dear Ms. DeHerrera: <br />I have received your May 5, 2014 e-mail inquiry as to a legal water supply for an asphalt and concrete <br />batch plant operation to be located within the existing Valdez Gravel Pit area. The pit is located within <br />the NW% Section 32, T33N, R9E, NMPM, about one mile southwest of Antonito. Conejos County is <br />currently doing an administrative review of an application by Randall and Lou Ann Robins (Robins) to <br />locate the batch plant at the Valdez Pit. You have inquired as to a legal water supply for the asphalt and <br />concrete batch plant operations. <br />I have previously worked with Mr. Robins to determine the legal use of Well No. 2, Case No. W-953, <br />Permit No. 5312-F. Well No. 5312-F was the main water supply for the sawmill operation located within <br />the SW% Section 29, T33N, R9E, NMPM and very near Antonito. The sawmill was in operation from <br />approximately 1961 through 1974. Well permit no. 5312-F was issued on March 24, 1964. The well was <br />completed to a depth of 150 feet on April 16, 1964. The well was adjudicated for 100 gpm for <br />commercial use on November 20, 1975. <br />The position I took in my September 27, 2013 letter to Scott Johnson, Robins' engineer, was that the <br />historic use of well no. 5312-F averaged 9.0 acre-feet / year for the period 1964 — 2012. The estimated <br />maximum annual withdrawal was 37.0 acre-feet during the high production years of 1964 —1974. 1 <br />approved the use of the well to supply water for the proposed grave( pit 1 batch plant within the NE% of <br />Section 31, T33N, R9E, NMPM (Robins Pit). I do not see a conflict with the use of that same well as a <br />water supply for an asphalt 1 concrete operation on adjacent land. <br />Therefore, so long as these volumetric limitations are not exceeded and the well is used consistent with <br />the decree, I will not oppose the use of the well to supply water for the proposed gravel pit 1 batch plant <br />within the existing Valdez Pit within the NW'/ of Section 32, T33N, R9E. NMPM. The average annual <br />use must not exceed 9.0 acre-feet in any five consecutive year period as detailed in State Engineer <br />Policy 2013-01.
