Final Compensatory Mitigation and Monitoring Plan—Version 2.0 <br />Climax Mine Overburden Storage Facility Expansion (SPK-2013-00045) <br />March 2017 Bikis Water Consultants, a division of SGM Page 20 <br />7.0 DETERMINATION OF CREDITS <br />Based on consultations with the Corps and USEPA, and additional input from the Corps in <br />February 2017 the mitigation in this plan is based on a mitigation ratio of 2.2:1 (created to <br />impacted wetlands). This ratio is judged to be appropriate considering the nature of the <br />impacted wetlands and proposed mitigation, with the goal of minimizing temporal loss of wetland <br />functions. This mitigation ratio may be re-evaluated in the future for other phases based on the <br />success of the Lake Irwin mitigation site and any changes to this Plan. <br />8.0 SITE PROTECTION INSTRUMENT <br />The Lake Irwin mitigation site is on land owned by Climax and is within the approved Mine <br />Permit Area. Climax will place a deed restriction on the mitigation site to prevent future impacts <br />and changes in use. Climax successfully used a deed restriction to protect the wetland <br />mitigation at the PDWTP site in 2012 (Corps No. 2011-00907). A copy of this previous deed <br />restriction, which will be modified for use at the Lake Irwin site, is included in Appendix D. <br />9.0 MAINTENANCE PLAN <br />Climax will be responsible for maintenance of the Lake Irwin mitigation site and for the site <br />ultimately meeting the performance standards. Climax will set up a regular maintenance and <br />inspection schedule to inspect the mitigation area regularly as part of the site-wide water <br />management program. <br />Inspections of the mitigation site will be performed by a wetland ecologist/consultant at a <br />minimum of twice per growing season in the first year following completion of each phase, then <br />annually thereafter. Potential maintenance is anticipated to occur primarily after construction of <br />each phase of the mitigation; but generally very little maintenance is expected as the site <br />becomes established. The site is intended to eventually require no maintenance following a <br />period of five years after completion. Any deficiencies will be noted during the inspections and <br />actions completed to correct them. <br />Potential maintenance could include: <br />Alterations of the water level in the lake (via inflow and outflow controls) to promote an <br />optimum level to sustain wetland plants over the growing season,
