BEFORE THE MINED LAND RECLAMATION BOARD <br /> STATE OF COLORADO <br /> Notice of Violation No. PV-2017-004 <br /> FINDINGS OF FACT, CONCLUSIONS OF LAW, AND ORDER <br /> IN THE MATTER OF A POSSIBLE VIOLATION BY RED ARROW GOLD <br /> CORPORATION, REVOCATION, CEASE AND DESIST ORDER, CORRECTIVE <br /> ACTION, AND FINDING FINANCIAL WARRANTY SUBJECT TO FORFEITURE FOR <br /> FAILING TO PAY ANNUAL FEES, FILE ANNUAL REPORTS, AND FILE ANNUAL <br /> MAPS, File No. P-2012-007 <br /> THIS MATTER came before the Mined Land Reclamation Board ("Board") in on <br /> May 24, 2017 in Denver, Colorado for a hearing to consider a possible violation by Red <br /> Arrow Gold Corporation ("Prospector"), cease and desist order, corrective actions, and <br /> civil penalties for failing to pay annual fees, file annual reports, and file annual maps, file <br /> number P-2012-007. Michelle Ramirez appeared on behalf of the Division of <br /> Reclamation, Mining and Safety ("Division"). There was no appearance on behalf of <br /> Prospector. <br /> The Board, having considered the Division's presentation and being otherwise <br /> fully informed of the facts and law, hereby enters the following findings of fact, <br /> conclusions of law, and order. <br /> FINDINGS OF FACT <br /> 1. Prospector holds a Notice of Intent to Conduct Prospecting Operations <br /> ("NOI") for a gold, silver, and copper prospecting operation located in Section 14, <br /> Township 36 North, Range 12 West, 10th P.M. in Montezuma County. The site is <br /> known as the Red Arrow Mine Drill #2. <br /> 2. On April 1, 2015, the Division sent Prospector an Annual Fee Invoice and <br /> Report Request for the 2015 annual report for the NOI. <br /> 3. On March 16, 2016, the Division sent Prospector an Annual Fee Invoice and <br /> Report Request for the 2015 annual report for the NOI. <br /> 4. On May 4, 2016, the Division received a letter from Prospector. On May <br /> 10, 2016, the Division responded to that letter, clarifying that annual fees and reports are <br /> past due. <br /> 5. On October 13, 2016, the Division mailed the Prospector a thirty-day grace <br /> letter. <br />
