The letter included questions inquiring about the <br />Division of Reclamation. Mining and Safety's (the Division) Rules and Regulations and policies <br />pertaining to post mining land use changes. The information you have requested is included <br />below. <br />The Rules and Regulations for coal mines can be found at the Division's web site, <br />nlining.state. co. its. The tab labeled Rules and Regs will contain a link to the Regulations of the <br />Colorado Mined Land Reclamation Board for Coal Mining. Rule 4.16.3 in this document is for <br />Alternative land uses and is a sub -section of Rule 4.16 -Post Mining Land Use. The Regulations <br />of the Colorado Mined Land Reclamation Board for Coal Mining were promulgated on August <br />30, 1980. The permit for the Bowie No. 1 Mine was obtained from the Division on September <br />24, 1981. The Division's Rules do not contain any regulations or requirements on third party <br />agreements. It has been the Division's policy to stay uninvolved with third party agreements. <br />Oxbow Mining LLC changed portions of its land's the post mining land use with the approval of <br />Technical Revision No. 76 at the Elk Creek Mine (C-1981-022). The Roadside Mine (C-1981- <br />041) changed some of its land's post mining land uses from fish and wildlife to <br />industriaL`commercial with the permitting actions of Permit Revision No. 3, No. 4 and No.6. The <br />Files containing this information can be located at the Division's website. Select the Reports and <br />Data tab and then on the left column titled Mining Data, Select the Imaged Document Data. This <br />will take you to a link to input the mines' permit number and revisions.
