7/25/2017 State.co.us Executive Branch Mail - Fwd: Adequacy letter and request for extension on decision (Bowie) dated July 19 <br />how the two sediment ponds are going to be cleaned and regraded/refilled, then monitored. They are part of the <br />contract purchase 30 acre area. They are not in the application showing Mark Levin's plans --he is not planning <br />any grading or other work (at least in the original application stating the letter of intent Bowie references. There <br />is a real concern about the sediment ponds possibly flooding or not being monitored and affecting the Farmers <br />Ditch as well as the aquifer and river. <br />Who is going to be responsible for the metal plated undercrossing under the repositioned Black Bridge Road? <br />We tried to find mention of this metal culvert in the RCE and could not find it. We are asking you if there is a <br />separate agreement made for this land and the undercrossing. This could be a major cost and hazard if it is not <br />removed and the road restored. Mark Levin's letter of intent in the original application states he "does not intend <br />to remove the metal plated undercrossing" through which the railroad spur used to run, up to the Load out. The <br />rail bed (still not reclaimed) without the tracks and ties, is there and is mentioned in the application as being <br />used by Levin. <br />Will you be revising or sending out another adequacy letter? <br />Lastly, what is the extension for a what decision did Bowie request? Is the decision regarding the approval of PR5? if <br />so, how could that be since there has been no response to the June 2 adequacy letter? <br />Thank you for a quick response on this --we need the information so we can deal with any new comments or letters. <br />Perhaps there were some not posted on the DRMS website?
