ADDENDUM TO LEASE AGREEMENT <br />DATED JUNE 30, 2006 <br />BETWEEN <br />THOMAS CURRY, D/B/A TRI COUNTY GRAVEL ("LANDLORD") <br />AND <br />OLDCASTLE SW GROUP, INC., ("TENANT") <br />In consideration of the following covenants, and notwithstanding any term or condition set forth in the <br />above Lease Agreement, Contractor and Subcontractor agree to modify and amend the above -referenced <br />Subcontract as follows: <br />1. Provision 1 e of the Lease Agreement is amended to provide that "Minimum Royalty Amount" <br />meas <br />2. Provision 2 of the Lease Agreement is amended to provide that, so long as Tenant is not then in <br />default hereunder and so long as the Depletion Date has not occurred, this Lease shall automatically renew for an <br />additional ten-year period upon the expiration of the Second Renewal Term ("Third Renewal Term'). Further, this <br />Lease shall automatically renew for an additional ten-year period upon expiration of the Third Renewal Term <br />("Fourth Renewal Term") and thus shall extend through June 30, 2036 so long as Tenant is not in default upon the <br />expiration of the Third Renewal Term and so long as the Depletion Date has not occurred. Landlord waives and <br />releases any right to refuse to renew the Lease except in the event of a default and/or the occurrence of the Depletion <br />Date. <br />3.
