Compliance With Terms and Conditions of Previous Permit <br />Effluent Limitations - The data shown in the preceding DMR tables indicate apparent violations of the permit. <br />During the previous permit term, the facility exceeded permit limitations at surface water outfalls for conductivity <br />and sodium 30 -day averages (001B and 001C); TSS 30 -day and 7 -day averages (007); total recoverable iron 30 -day <br />average (007). The violations for conductivity, sodium, TSS and total recoverable iron at these outfalls were <br />irregular, and did not occur with each sampling event. <br />The facility also exceeded permit limitations at groundwater monitoring wells for BODS 30 -day and 7 -day average <br />(033A); TSS 30 -day and 7 -day average (033A); pH maximum (0506); coliform 30 -day average and daily maximum <br />(0506, 050C, 050D), dissolved iron 30 -day average (0506, 050C); dissolved manganese 30 -day average (0506, 050C, <br />050D) and nitrate 30 -day average (050C, 050D). As previously noted, internal outfall 033A and associated <br />groundwater monitoring wells 050A, B, C Et D are not included in this permit renewal. Additionally the facility did <br />not meet deadlines for compliance schedule items and received DMR violations for delinquencies and deficiencies. <br />The division has not yet resolved these violations - any enforcement actions for violations of permit terms and <br />limitations are handled by the Clean Water Compliance Unit. <br />In accordance with 40 CFR Part 122.41(a), any permit noncompliance constitutes a violation of the Clean Water Act <br />and is grounds for enforcement action; for permit termination, revocation and reissuance, or modification; or <br />denial of a permit renewal application. <br />
