9. Applicant submitted Minor Revision 82 (`AIR -82") to the Division on <br />December 7, 2015. AIR -82 proposed to add the hydrologic communication repair <br />plan commitments from SL -08 to the permit. The Division did not receive any <br />comments or objections to AIR -82. The Division approved AIR -82 on December <br />21, 2015. <br />10. TR -69 seeks to fulfill Applicant's hydrologic communication repair <br />plan commitments. <br />11. On April 6-9, 2016, Fugro Consultants, Inc. ('Fugro") conducted an <br />Electrical Resistivity Tomography ("ERT") study at the mine site. Fugro issued a <br />written report of that study on April 25, 2016 ("April 2016 ERT Report"). <br />12. On April 28, 2016, J.E. Stover submitted to the Division a report of its <br />investigation of the potential hydrologic communication between the Roadside <br />Portals Aline and overlying properties, including the April 2016 ERT Report. <br />13. The April 2016 ERT Report indicated the existence of a vertical low <br />resistivity zone in the subsurface at a location that correlated with the location of <br />an historic air shaft. <br />14. On May 9, 2016, HBET issued a report finding that the old air shaft <br />was the pathway for water migration into the mine, observing that the ERT study <br />showed no other significant anomalies in the area, and restating that the site <br />geology- is not conducive to natural development of sinkhole pathways originating <br />from the mine workings. <br />15. On July 22-25, 2016, Fugro conducted a second ERT study at the mine <br />site. On August 23, 2016, Fugro issued a letter to HBET ("August 2016 ERT <br />Report") to "present the results of the shallow focused electrical resistivity survey to <br />further delineate underlying drainage pathways at the Snowcap Coal Mine." <br />16. On August 25, 2016, HBET issued a supplemental geophysical <br />investigation report to Applicant with Fugro's August 2016 ERT Report. <br />17. On September 28, 2016, Applicant submitted to the Division an <br />application for approval of Technical Revision 69 ("TR -69"). The Division deemed <br />the application for TR -69 to be complete on October 7, 2016. Applicant provided the <br />required public notice of the application for TR -69. <br />18. The application for TR -69 stated that TR -69 was specifically for <br />"[s]ubmittal of a new hydrological communication repair plan[,] reclamation plan <br />and cost estimate for the repair and reclamation plans as per SL -8 Decision and <br />Findings of Compliance." <br />Snowcap Coal Company, Inc. <br />Roadside Portals Mine / C-1981-041 3 <br />
