BEFORE THE MINED IyAND RECLAMATION BOARD <br />STATE OF COLORADO <br />FINDINGS OF FACT, CONCLUSIONS OF LAW, AND ORDER <br />IN THE MATTER OF THE APPLICATION OF SNOWCAP COAL COMPANY, <br />INC. FOR A TECHNICAL RE`'ISION, File No. C-1981-041 <br />THIS MATTER came before the Mined Land Reclamation Board ("Board") on <br />May 24 and 25, 2017 in Denver for a hearing to consider the application for a <br />technical revision to permit number C-1981-041 filed by Snowcap Coal Company-, <br />Inc. ("Applicant"). Assistant Attorney General Scott Schultz, James Stark, and <br />Michael Boulay appeared on behalf of the Division of Reclamation, Mining and <br />Safety- ('Division"). John Justus, Esq.; James Hill; Michael Berry; James Stover; <br />and Tonya Hammond appeared on behalf of Applicant. James Beckwith, Esq. <br />appeared on behalf of objector Fontanari Revocable Trust (`Objector Fontanari"). <br />Gregory- Stutz, Esq. and Jason Carey appeared on behalf of objector Jason Carey <br />('Objector Carey;" Objector Fontanari and Objector Carey are referenced collectively <br />herein as "Objectors"). <br />The Board, having considered the presentations, testimony, and evidence of <br />the Division', Applicant, and Objectors, and being otherwise fully informed of the <br />facts in the matter, enters the following: <br />FINDINGS OF FACT <br />1. Applicant holds reclamation permit number C-1981-041 for an <br />underground coal mine located in Section 35, Township 10 South, Range 98 West, <br />6th Principal Meridian, Mesa County, Colorado. The site is known as the Roadside <br />Portals l\Iine. <br />2. The site was mined using modern mechanized methods beginning in <br />1974 and continuing until final cessation of coal extraction from the site in <br />December 1999. The site was a room and pillar and retreat mine. <br />3. On September 4, 2013, the Division received Bond Release Application <br />SL -08 ("SL -08") from Applicant. Objector Fontanari received notice of the bond <br />release application and the pending site inspection by the Division. Objector <br />Fontanari submitted an objection to the bond release application. J.E. Stover & <br />Associates, Inc. (" J.E.
