Answer: Bowie is responsible for all permit conditions until the Division releases the applicable areas <br />from its jurisdiction. This is a fairly detailed and lengthy process that includes public notification and <br />participation. <br />FOLLOWUP QUESTION: If the change of use is approved by Delta County, and DRMS comes in <br />to inspect the site prior to release of bond, if the new owner is not using the ponds or the <br />railroad bridge or some of the crumbling concrete on the loadout area, does DRMS consider <br />those areas still `sok" and used under the new post mining alternative use and will approve <br />release of the bond? <br />
