Should a well permit be denied for reasons of 600 foot spacing, or any <br />other legitimate reason, approval of this substitute supply plan may be cancelled. <br />3. The total surface area of the groundwater exposed at the site must not exceed 0.49 <br />acres in the Freshwater Pond, which results in a maximum annual evaporative loss of <br />1.02 acre-feet. Should the exposed water surface area exceed this amount, an <br />amendment will need to be filed with this office. <br />4. The total product mined at the site shall not exceed 475,000 tons per year, which <br />results in 12.23 acre-feet of water used for processing, the annual amount of water <br />used for dust control shall not exceed 10.73 acre-feet, and the surface area of the <br />Recirculation Pond must not exceed 1.10 acre, which results in a maximum annual <br />evaporative loss of 2.29 acre-feet. <br />5. Total consumption at the Trout Valley Ranch must not exceed these aforementioned <br />amounts unless a new SWSP is obtained. <br />6. Applicant shall replace the net evaporative depletions from the exposed water surface <br />area that may occur during the assumed ice covered period (December through <br />February) for any time that the exposed ground water in the pond(s) is not completely <br />covered by ice. <br />7. Approval of this SWSP is for the purposes as stated herein. Additional wells and/or <br />additional uses for the water that is the subject of this SWSP will be allowed only if a <br />new SWSP is approved for those additional wells/uses. <br />8. All pumping for dust control and/or processing shall be measured in a manner <br />acceptable to the division engineer. The Applicant shall install and maintain <br />measuring devices as required by the division engineer for operation of this SWSP. <br />9. The name, address and phone number of the contact person who will be responsible <br />for the operation and accounting of this plan must be provided with the accounting <br />form to the division engineer and water commissioner. <br />10. Adequate accounting of depletions and replacements must be provided to the division <br />engineer in Greeley (DNR_Div1Accounting@state.co.us) and the water commissioners <br />(Garver Brown at Garver.Brown@state.co.us and Tim Buckley at <br />Tim.Buckley@state.co.us) on a monthly basis, or more frequent if required by the <br />water commissioner, within 30 days of the end of the month for which the accounting <br />applies. All amounts shall be in acre-feet. All submitted accounting must conform to <br />the Administration Protocol “Augmentation Plan Accounting – Division One, South <br />Platte River” (attached). NOTE: Monthly accounting, even during the winter non- <br />irrigation season, is required. <br />11. Applicant shall verify that the entity making replacement, in this case North Fork <br />Associates, LLC and Mountain Mutual Reservoir Company, has included them on their <br />accounting submitted to our office. <br />12. All releases of replacement water must be sufficient to cover all out-of-priority <br />depletions in time, place, and amount and must be made under the direction and/or <br />the approval of the water commissioner. Notice must be provided and approval made <br />by the water commissioner at least 48 hours prior to the release of replacement <br />water, or as required by the water commissioner.
