1. This SWSP shall be valid for the period of June 1, 2017 through May 31, 2019, unless
otherwise revoked or superseded by decree. Should an additional SWSP be requested,
such renewal request must be submitted to this office and the Division 2 office (please
copy Kathy Trask at [e-mail]) with the statutory fee per gravel pit
(currently $257) at least 90 days prior to the expiration date of this plan.

2. Active mining or dust control shall not occur at the site under this SWSP. Should the
operator desire to resume mining or provide water for dust control at the site, a new
SWSP must be obtained.

3. No more than 22.6 acres (7.2 acres of post-1981 exposure) of ground water may be
exposed at the Cañon City East Pit during this plan period without first obtaining a
new SWSP. Documentation of pond sizes may be required by the Division Engineer in
the form of an aerial photo evaluation or survey by a Professional Land Surveyor during
the plan year.

4. The consumption associated with this mining operation is limited to evaporation not to
exceed 22.3 acre-feet/year.

5. Conveyance loss for delivery of augmentation water to the Arkansas River is subject to
assessment and modification as determined by the Division Engineer.

6. Replacement water shall be made available to cover all out-of-priority depletions in
time, place, and amount and shall be made available under the direction and/or
approval of the Water Commissioner. The replacement water, which is subject of this
SWSP, cannot be sold or leased to any other entity during the term or this SWSP
without prior approval of the Division Engineer.

7. Accounting of water in this plan, including area of actual ground water exposure,
stream depletions, and replacement water deliveries must be provided to the Water
Commissioner ([e-mail]) and to the Division Engineer
([e-mail]) on forms and at times acceptable to them.
Said accounting must be received by the 10th of the month following the month being
reported. The name, mailing address, and phone number of the contact person who
will be responsible for the operation and accounting of this SWSP must be provided
with the accounting forms to the Division Engineer and Water Commissioner.
Accounting and reporting procedures are subject to approval of modification by the
Division Engineer.

8. The approval of this SWSP does not relieve the Applicant and/or landowner of the
requirement to obtain a Water Court decree approving a permanent plan for
augmentation or mitigation to ensure the permanent replacement of all depletions,
including long-term evaporation losses and lagged depletions after gravel mining
operations have ceased. The Applicant has filed application with the Division 2 Water
Court for a plan for augmentation in case no. 17CW3021; therefore, the Applicant
must continue to purse case no. 17CW3021 until decreed by the Division 2 Water
Court.
