This SWSP shall be valid for the period of June 1, 2017 through May 31, 2019, unless <br />otherwise revoked or superseded by decree. Should an additional SWSP be requested, <br />such renewal request must be submitted to this office and the Division 2 office (please <br />copy Kathy Trask at Kathy.Trask@state.co.us) with the statutory fee per gravel pit <br />(currently $257) at least 90 days prior to the expiration date of this plan. <br /> <br />2. Active mining or dust control shall not occur at the site under this SWSP. Should the <br />operator desire to resume mining or provide water for dust control at the site, a new <br />SWSP must be obtained. <br /> <br />3. No more than 22.6 acres (7.2 acres of post-1981 exposure) of ground water may be <br />exposed at the Cañon City East Pit during this plan period without first obtaining a <br />new SWSP. Documentation of pond sizes may be required by the Division Engineer in <br />the form of an aerial photo evaluation or survey by a Professional Land Surveyor during <br />the plan year. <br /> <br />4. The consumption associated with this mining operation is limited to evaporation not to <br />exceed 22.3 acre-feet/year. <br /> <br />5. Conveyance loss for delivery of augmentation water to the Arkansas River is subject to <br />assessment and modification as determined by the Division Engineer. <br /> <br />6. Replacement water shall be made available to cover all out-of-priority depletions in <br />time, place, and amount and shall be made available under the direction and/or <br />approval of the Water Commissioner. The replacement water, which is subject of this <br />SWSP, cannot be sold or leased to any other entity during the term or this SWSP <br />without prior approval of the Division Engineer. <br /> <br />7. Accounting of water in this plan, including area of actual ground water exposure, <br />stream depletions, and replacement water deliveries must be provided to the Water <br />Commissioner (Joshua.Kasper@state.co.us) and to the Division Engineer <br />(AugmentationCoordinator@state.co.us) on forms and at times acceptable to them. <br />Said accounting must be received by the 10th of the month following the month being <br />reported. The name, mailing address, and phone number of the contact person who <br />will be responsible for the operation and accounting of this SWSP must be provided <br />with the accounting forms to the Division Engineer and Water Commissioner. <br />Accounting and reporting procedures are subject to approval of modification by the <br />Division Engineer. <br /> <br />8. The approval of this SWSP does not relieve the Applicant and/or landowner of the <br />requirement to obtain a Water Court decree approving a permanent plan for <br />augmentation or mitigation to ensure the permanent replacement of all depletions, <br />including long-term evaporation losses and lagged depletions after gravel mining <br />operations have ceased. The Applicant has filed application with the Division 2 Water <br />Court for a plan for augmentation in case no. 17CW3021; therefore, the Applicant <br />must continue to purse case no. 17CW3021 until decreed by the Division 2 Water <br />Court. <br />
