Colorado Division of Reclamation Mining & Safety vis <br />Department of Natural Resources <br />Attention: Tony Waldron <br />1313 Sherman Street, Room 215 <br />Denver, C0 80203 RECEIVED <br />February 14, 2017 <br />FEB 15 201..,. <br />DIVISION OF RECLAMATION <br />Dear Mr. Waldron, MNINGANDSAFETY <br />Del Sol Ranch <br />Yx 2;3 <br />6 5 0 01U."S ffivv 4.0 <br />Dinosaur, CO 81610 <br />I am requesting that Ms. Amy Yeldell be removed immediately from the review and <br />approval, of any reclamation plans and bonding process for the Powell Gravel Pit # <br />M1995012. <br />Ms Yeldell has in the past, implied and stated multiple times to myself, my sister and a <br />consultant that the hill in the central portion of the pit needed to be reclaimed. We <br />believed that this was the case, even though I have never mined 6.22 acres (includes <br />majority of hili) of the pit since 1995. 1 began a reclaim on 1.03 acres in October of 2016 to <br />begin the process and spent over $3.2,000.00 in the process. Since then, Ms. Yeldell has <br />defined areas that were mined before 1995, and 1 have not mined, as pre -law, and implied <br />that I was not liable unless I mined the area. Spending $12,000.00 was apparently not <br />needed even though originally told. <br />I have had a reclamation plan written in an attempt to define my liability for reclaiming the <br />rest of the pit. Ms. Yeldell has presented a series of "movable" methods or targets and <br />seeming endless stipulations. Therefore, I am requesting the removal of Ms. Yeldell and a <br />period of 60 days to reset and begin anew to resolve this. I do not wish to spend more time <br />and money or of the consultants, in chasing moving targets after having misspent $12,000, <br />until I can be assured of a good falth and reasonable approach to this matter. <br />have asked the retained consultant to not submit any more documents or information to <br />the State of Colorado until this is resolved in an acceptable manner. <br />My intent is to obtain a release for all areas 1 have not mined, including the area that 1 <br />contoured and seeded but never mined as it was not needed, within 2017. For the rest of <br />the pit I am going to apply for a period of idleness, where no product is sold (five years I <br />believe) to reassess the economics of the pit. Given the past history of the pit I suspect, that <br />unless a considerable change occurs in the local area the pit will be closed. <br />I have included a map of the pit (22x34) that was provided by the consultant; the acreages <br />are also from them. <br />appreciate your consideration in this manner. <br />Sincerely; <br />Cork Powell <br />cc.
