OF COLORADO <br />NOTARY W =640IMS <br />NIYCOMIMISSION EXPIRES DUMMY <br />15441-1 <br />NOTICE OF PROPOSED DECISION <br />The Colorado Division of Reclamation, <br />Mining and Safety proposes to approve <br />Technical Revision <br />Application No. 87 ( TR -87) for the Foidel <br />Creek Mine ( Permit No. C-1982-056), sub- <br />mitted by <br />Twentymile Coal, LLC. The revision is to <br />address water observed at the 9 -Right <br />and 10 -Right <br />seals. This water is considered to be <br />coming.from.the thickener underflow dis- <br />chargge in 8 -Right <br />due to a blockage in the area of 8 -Right . <br />This revision proposes to shift the thick- <br />ener underflow <br />discharge to another location. The pro- <br />posed locations include: 1) A temporary <br />measure to shift <br />discharge to exisiting approved 11VIN Re- <br />placement Thickener Underflow Bore- <br />hole. 2) As a backup <br />plan, a previously approved basin adja- <br />cent to Area 1 Pit be re -excavated. 3) As a <br />longer-term <br />solution, installing a thickener underflow <br />borehole and connecting pipeline from <br />the exisiting <br />thickener underflow pipeline. <br />The Foidel Creek Mine is a/an under- <br />ground coal mine located in Routt Coun- <br />ty, approximately 23 <br />miles SW of Steamboat Springs, <br />Colorado. Coal interest is federal, state <br />and private, and the <br />surface affected is federal, state and pri- <br />vate land. The permit area encompasses <br />approximately <br />22,607.00 acres. <br />This proposed decision is based on a <br />finding that the proposed operation will <br />comply with all <br />requirements of the Colorado Surface <br />Coal Mining Reclamation Act, Section 34- <br />33-101, et seq., <br />C.R.S., and the regulations promulgated <br />thereunder. <br />Copies of the proposed decision, includ- <br />ing stipulations, are on file for public in- <br />spection at the <br />Colorado Division of Reclamation, Mining <br />and Safety, Room 215, Centennial Build- <br />ing, 1313 <br />Sherman Street, Denver, Colorado 80203. <br />Persons with an interest that may be ad- <br />versely affected <br />by the proposed decision may request a <br />formal hearing before the Mined Land <br />Reclamation Board <br />on the proposed decision.
