OF COLORADO NOTARY W =640IMS NIYCOMIMISSION EXPIRES DUMMY 15441-1 NOTICE OF PROPOSED DECISION The Colorado Division of Reclamation, Mining and Safety proposes to approve Technical Revision Application No. 87 ( TR -87) for the Foidel Creek Mine ( Permit No. C-1982-056), sub- mitted by Twentymile Coal, LLC. The revision is to address water observed at the 9 -Right and 10 -Right seals. This water is considered to be coming.from.the thickener underflow dis- chargge in 8 -Right due to a blockage in the area of 8 -Right . This revision proposes to shift the thick- ener underflow discharge to another location. The pro- posed locations include: 1) A temporary measure to shift discharge to exisiting approved 11VIN Re- placement Thickener Underflow Bore- hole. 2) As a backup plan, a previously approved basin adja- cent to Area 1 Pit be re -excavated. 3) As a longer-term solution, installing a thickener underflow borehole and connecting pipeline from the exisiting thickener underflow pipeline. The Foidel Creek Mine is a/an under- ground coal mine located in Routt Coun- ty, approximately 23 miles SW of Steamboat Springs, Colorado. Coal interest is federal, state and private, and the surface affected is federal, state and pri- vate land. The permit area encompasses approximately 22,607.00 acres. This proposed decision is based on a finding that the proposed operation will comply with all requirements of the Colorado Surface Coal Mining Reclamation Act, Section 34- 33-101, et seq., C.R.S., and the regulations promulgated thereunder. Copies of the proposed decision, includ- ing stipulations, are on file for public in- spection at the Colorado Division of Reclamation, Mining and Safety, Room 215, Centennial Build- ing, 1313 Sherman Street, Denver, Colorado 80203. Persons with an interest that may be ad- versely affected by the proposed decision may request a formal hearing before the Mined Land Reclamation Board on the proposed decision. Such request must be made within ten (10) days of the initial publication of this notice, must be in writing, and must state with reasonable specificity the reasons for the request and the objections to the pro- posed decision.
