Colorado 80363 <br />June 20, 2017 <br />Vista Del Sol Ranch <br />Attn: Cecil "Cork" Powell <br />6500 U.S Hwy 40 <br />Dinosaur, CO 81610 <br />RE: Powell Gravel Pit; DRMS File M-1995-012; Request for Change of Lead Specialist <br />Dear Mr. Powell: <br />This letter is written in response to your February 15, 2017 letter requesting that Ms. Amy Yeldell be <br />removed from review and approval of the reclamation and bonding process for the Powell Gravel Pit. In <br />response to your letter I requested that Ms. Yeldell brief me on the facts surrounding the events outlined <br />in your letter as it relates to the Powell Gravel Pit. While Ms. Yeldell is relatively new to inspecting this <br />site, she informed me that there appears to have been a history of mis-communication surrounding the <br />site, including delineation of what areas were approved for mining and reclamation. In addition, Ms. <br />Yeldell informed me that a technical revision (TR -01) had recently been submitted in an effort to clarify <br />these discrepancies and final approval for that revision had just been granted. Ms. Yeldell provided me a <br />copy of the approval for TR -01 describing the revised reclamation plan that you and/or your consultant <br />agreed to for this site. That revision approval letter appeared to provide a very reasonable path forward <br />for reclamation of this site along with a modest bond increase of $3,127.91. TR -01 was approved on <br />February 17, 2017 and mailed to you on March 2, 2017. It required that the additional bond be posted by <br />May 1, 2017. <br />Based on submittal, review and approval of this revision, we now seem to be at a point where we can all <br />agree upon the basic facts surrounding this permit. These include the approved permit boundary, a starting <br />date by which all disturbances occurring after that date will be reclaimed and what method of reclamation <br />will be utilized to accomplish final bond release. It appears that all disturbances post 1995 will be included <br />in this revised plan and it allows for a mix of final reclamation including re -grading slopes, re -applying <br />topsoil, seeding of certain areas and grading other areas as an equipment storage yard. <br />Now that we have a fresh plan it should be clear what the expectations are for both sides moving forward, <br />but in order for this plan to succeed both sides must perform their respective duties. The first thing is that <br />the modest bond increase associated with TR -01 must be posted. This increase in the amount of <br />$3127.91was due May 1, 2017. To date, the Division has not received the increase in warranty. I waited <br />to send this letter hoping that the bond would be posted and this disagreement would be behind us. <br />Unfortunately that has not happened, however, in the spirit of cooperation, I am extending the timeframe <br />for submittal of this bond until July 31, 2015.
