G.L. Pit SWSP June 19, 2017 <br />Plan ID 5369 Page 2 of 4 <br /> <br />Office of the State Engineer <br />1313 Sherman Street, Room 821, Denver, CO 80203 P 303.866.3581 <br />www.water.state.co.us <br /> <br /> <br />Lagged depletions will total 0.07 acre-feet for this plan period. A monthly breakdown of the <br />lagged depletions is shown in the attached Table 2. As shown in Table 2, all remaining lagged <br />depletions will accrue to the river during this plan period. <br />Replacements <br />The proposed source of replacement water for this pit is a lease of fully consumable water <br />from the Lake Canal Reservoir Company (“LCRC”). A letter from the LCRC indicating that they have <br />reserved 1.0 acre-foot of water for use in this SWSP, dated April 28, 2017, is attached. The <br />replacement water will come from a system of reservoirs owned by LCRC known as the Gray Lakes, <br />located in Section 34, T8N, R68W, 6th P.M. Water from the reservoirs is delivered to Boxelder Creek <br />and then to the Cache la Poudre River, downstream of the G.L. Pit. The LCRC obtained a decree in <br />Division 1 Water Court case no. 2006CW276 to change the use of water stored in North Gray <br />Reservoir (WDID 0303750) and South Gray Reservoir (WDID 0303751) to add augmentation and <br />replacement use. The G.L. Pit is located within the River Reach described in case no. 2006CW276. <br />A total of 0.16 acre-feet of water will be released from the Gray Lakes for replacement <br />purposes under this plan, of which 0.07 acre-feet represents the consumptive use portion to be <br />used as replacement water, and 0.09 acre-feet represents the return flow obligations. A monthly <br />breakdown of projected replacements and depletions is shown in the attached Table 3. Transit <br />losses may be assessed as determined by the water commissioner or division engineer (currently <br />assessed at 0.25% per mile along Boxelder Creek for 6.3 miles). The use of the LCRC water must be <br />in accordance with the decree entered in case no. 2006CW276. The accounting for case no. <br />2006CW276 was approved on January 14, 2016, as required by the decree. Delivery of replacement <br />water to the confluence of Boxelder Creek and the Poudre River is anticipated to be sufficient <br />during the irrigation season; however, this replacement location may not be sufficient for the non- <br />irrigation season if the Timnath Inlet Canal (WDID 0300924) is calling for water. The canal <br />headgate is located below the G.L. Pit but above the confluence of Boxelder Creek with the Cache <br />la Poudre River. At times when the Timnath Inlet Canal has placed a valid call for water, the <br />Applicant shall ensure that the LCRC water is instead delivered to the canal. The proposed <br />operational plan, when the Timnath Inlet Canal is calling for water, is to deliver the replacement <br />water to the Lake Canal diversion structure located off of Box Elder Creek where the water will be <br />measured and recorded. The water will then run down Lake Canal to a point on the canal were the <br />water will be delivered to the Timnath Inlet Canal. <br />Long Term Augmentation <br />The site has been backfilled to eliminate all ground water exposed within the mining <br />boundaries, and all remaining lagged depletions will be replaced under this SWSP; therefore there <br />are no ongoing depletions associated with the G.L. Pit that must be augmented. An Abandonment <br />Report has been filed for well permit no. 42334-F. <br />Conditions of Approval <br />I hereby approve the proposed substitute water supply plan in accordance with § 37-90- <br />137(11), C.R.S., subject to the following conditions: <br />1. This plan shall be valid for the period of June 1, 2017 through May 31, 2018 unless otherwise <br />revoked or superseded by decree. <br />2. Approval of this plan is for the purpose as stated herein. This SWSP does not authorize the <br />use or exposure of any ground water at the pit. Any additional uses for which the water
