Powers Circle <br />Littleton, CO 80123 <br /> <br />RE: Fairplay Au Pit; DRMS File No. M-1991-037; Adequacy Review No. 2 (CN01) <br /> <br />Dear Mr. Langenfeld, <br /> <br />The Division has identified several other comments and questions that must be addressed prior to <br />the Division’s decision due date. Please be advised that if you are unable to satisfactorily <br />address any concerns identified in this review before the decision date, it will be your <br />responsibility to request an extension of the review period. If there are outstanding issues <br />that have not been adequately addressed prior to the end of the review period, and no <br />extension has been requested, the Division will deny this application. <br /> <br />1. The current decision date for the Hard Rock 112 Conversion Application is set for June 26, <br />2017. The Division mailed the Preliminary Adequacy Review Letter on May 24, 2017. The <br />Division will need a sufficient amount of time to review your response to the letter and to <br />potentially write an additional Adequacy Review letter. Therefore, the Division requests that <br />you provide your responses to the Preliminary Adequacy Review Letter and to this letter no <br />later than June 19, 2017. <br /> <br />2. On June 12, 2017, the Division received a copy of a letter (see attached) from the Park County <br />Development Services which stated that High Speed Aggregate, Inc. is in violation of Park <br />County Land Use Regulations. In addition, Park County ordered you to cease and desist all mining <br />and commercial activities on the portions of the mining operation which are currently zoned for <br />residential uses. Pursuant to C.R.S. 34-32-115(4)(c), the board or office shall not deny a permit if <br />the Operator demonstrates that no part of the proposed mining operation, the reclamation <br />program, or the proposed future use is contrary to the laws or regulations of this state or the United <br />States, including but not limited to all federal, state, and local permits, licenses, and approvals, as <br />applicable to the specific operation.
