Decree <br /> Case No. 04CW6 <br /> 52.76 cfs. Adjusted river headgate diversions for the Box Elder Ditch <br /> averaged 6,136.5 acre-feet during the study period. Farm headgate deliveries <br /> to the Kehn Property were determined based on Applicant's pro rata amount <br /> of river headgate diversions minus ditch loss. Average annual farm headgate <br /> deliveries to the Kehn Property from the Water Rights for the study period, <br /> less average ditch losses of fifteen(15%)percent were as follows: <br /> Table 1 Farm Headgate Average Annual Deliveries (AF/YR) <br /> an reb Mar r Ma un ul ug ISepct Nov Oec otal <br /> 3 31.2 2.4 195.1 8.3 02.9 .0 85.2 <br /> 12.4. Historical Consumptive Use. The historical consumptive use of the Water <br /> Rights was determined by using the StateCU model with a maximum <br /> irrigation efficiency of 50% and a soil moisture water budget. The average <br /> annual historical consumptive use attributable to use of the water diverted <br /> pursuant to the Water Rights over the study period was 142.6 acre-feet. <br /> 13. Return Flows. The volume of surface water and subsurface (groundwater) return <br /> flows were calculated based on an assumed 50/50 split. During the study period, <br /> the average annual farm headgate deliveries were 285.2 acre-feet, the average <br /> annual historical consumptive use was 142.6 acre-feet, the average annual surface <br /> water return flows were 71.3 acre-feet and the groundwater return flows were also <br /> 71.3 acre-feet. Surface water returns are assumed to affect the Cache la Poudre <br /> River instantaneously. Groundwater returns were lagged using the IDS AWAS <br /> program, which utilizes a bounded Glover methodology. The following <br /> hydrogeological parameters were used in the IDS AWAS program, for <br /> determining the lagged groundwater return flows: X-Distance: 2,200 feet; W- <br /> Distance: 12,560 feet; Transmissivity: 30,000 gallons per day/foot; Specific <br /> Yield: 0.2. <br /> 14. Change of Use of Box Elder Ditch Company Shares. The uses of the subject <br /> Water Rights are hereby changed to augmentation, commercial and industrial <br /> uses associated with mining activities on the Kehn Property pursuant to the <br /> terms and conditions of this decree. There is no change in place of use or point <br /> of diversion of the Water Rights requested in the Application. <br /> 15. Terms and Conditions Regarding Change of Water Rights. The change of use for <br /> the Water Rights shall be on the following terms and conditions: <br /> 15.1. Diversions: The Water Rights shall continue to be diverted at the river <br /> headgate for the Box Elder Ditch Company at the same time as water is <br /> delivered to other Box Elder Ditch Company shareholders. Kehn shall <br /> continue to divert the Water Rights through the existing farm headgate that <br /> 4 <br />
