The quantity of water in the springs and seeps could be reduced by <br />subsidence cracks. Subsidence cracks could intercept the impervious layer <br />below the springs and seeps which would cause them to drain to the <br />formation below. <br />(a)(ii) Volume Il, Map 23, Water Rights Location shows the water rights within the <br />permit and adjacent area. Water right map codes 1, 2, 3, 4, 5, 11, 14, 15 & <br />32 are within the area that could be affected by mining. Map codes 1 through <br />5 are decreed water rights described as J & M Spring & PL No. 1 - 5. Map <br />code 11 is the Leonard Springs. Map code 32 is the Bowie Spring No. 3. <br />The Operator owns water right map codes1, 2, 3, 4, 5, 11,14 & 32. Map <br />codes 14 and 15 are Bowie Springs 17 and 13 respectively. <br />Map code 29, Terror Ditch is located outside of the permit boundary so there <br />will not be any direct effect on the structural integrity of the ditch. It is <br />possible but not likely mining under the West Fork of Terror Creek could <br />temporarily reduce the flow in the creek and thus reduce the flow available to <br />divert into Terror Ditch. <br />Map codes 7, 8 and 12 are located along Hubbard Creek beyond the <br />projected angle of draw. Decreed water right No. 6 is located outside the <br />permit boundary and will not be affected by mining. Water right no 13, Reds <br />spring and pipeline, is within the permit boundary but outside of the area <br />affected by mining. The water rights along old State Highway 133 should not <br />be adversely effected by the mining operation because these water rights are <br />in a formation that is geologically at least 800 feet below the mine workings. <br />The J & M Springs & Pipelines are claimed for domestic and stock watering <br />purposes. Water right numbers 1 and 3 are decreed for 4 gallons per minute. <br />Number 2 is decreed for 2 gpm. Numbers 4 and 5 are decreed for 5 gpm. <br />Leonard Springs Nos. 1 & 2 are decreed for 22.4 gpm <br />The USDA -FS has six ponds with decreed water rights located west of Terror <br />Creek within and north of the permit boundary. They all have the same <br />adjudication date and decree amount, 8/24/92 and 0.1 AF respectively. Map <br />23 numbers are shown in parentheses. They are known as E Terror 9 (76), <br />10 (60), 11(97), 12 (94), 13 (95) and 23 (94). <br />PR -14 2.05-108 06/14 <br />
