271 Such receiver may be appointed by any Court of competent jurisdiction upon ex parte application and <br /> 272 without notice; notice being hereby expressly waived. <br /> 273 Upon Acceleration under paragraph 18 (Acceleration; Foreclosure; Other Remedies)or <br /> 274 abandonment of the Property, Lender, in person, by agent or by judicially-appointed receiver, shall be <br /> 275 entitled to enter upon, take possession of and manage the Property and to collect the rents of the <br /> 276 Property including those past due. All rents collected by Lender or the receiver shall be applied, first to <br /> 277 payment of the costs of preservation and management of the Property, second to payments due upon <br /> 278 prior liens, and then to the sums secured by this Deed of Trust. Lender and the receiver shall be liable <br /> 279 to account only for those rents actually received. <br /> 280 21. Release.
