Zuber, P.E. <br />Environmental Protection Specialist <br />Division of Reclamation, Mining and Safety <br />1313 Sherman St., Room 215 <br />Denver, Colorado 80203 <br />"at;on, <br />Division of kectat <br />Mining & Safety <br />Re: New Elk Kline (Permit No. C-1981-012), Technical Revision No. 72 (M-72) Incidental permit boundary <br />change transferring three acres, Northwest Airshaft Site, from the Golden Eagle Mine permit (HC #71066) <br />Dear Mr. "Luber: <br />Thank you for your recent correspondence dated May 4, 2017 (received by our office on May 10, 2017) <br />regarding the subject undertaking. \YVe also appreciate the e-mail response we received on May 22, 2017 to our <br />request for a map showing the proposed area of additional surface disturbance. <br />\ search of the Colorado Cultural Resource lnventorN, Database indicates that no cultural resource inventories <br />hay e been conducted in the vicinity of the proposed area of additional disturbance and no cultural resources <br />clip ible for or listed to the National Register of Historic Places have been recorded therein. Our files contain <br />tncon-iplete information for this area and there is the possibility that as yet unidentified cultural resources exist <br />within the proposed permit area. <br />Because the proposed mining plan revision involves Federal oversight and proposes additional surface <br />disturbance outside the area currently approved, please note that it is the responsibility of the Federal <br />agencies involved to comply with Section 106 of the National Historic Preservation Act as set forth in 36 <br />CFR Part 800 ("Protection of Historic Properties"). This includes the identification of any historic <br />properties (i.e. cultural resources which are eligible to be listed in the National Register of Historic Places) <br />within the area of potential effects and determining whether the undertaking will have an effect upon such <br />properties. The State Historic Preservation Office, Native American tribes, representatives of local <br />governments, and applicants for Federal permits, licenses or other approval are entitled to consultative roles <br />In this process. <br />Thank you for the opportunity to comment.
