PERMIT#:M-2001-046 <br /> INSPECTOR'S INITIALS: ECS <br /> INSPECTION DATE: April 18,2017 <br /> OBSERVATIONS <br /> The Nix Sand & Gravel Mine was inspected by Eric Scott with the Division of Reclamation, Mining and Safety <br /> (Division) as part of the Division's monitoring inspection program. Mr. Joe Lamanna with Ready Mixed <br /> Concrete Company met the Division at the site for the inspection. The site was previously inspected by the <br /> Division on June 28, 2013. The Division holds a financial warranty in the amount of$317,000.00, which is <br /> adequate to reclaim the site based on this inspection, as the site has not yet been impacted. The mine sign was <br /> observed and the boundaries were defined by fence as required by Rule 3.1.12. <br /> As previously stated, the Nix site is undisturbed by mining activity and is currently being used for agricultural <br /> purposes. The site was driven from the north to south from Highway 66 to Weld County 28 along the interior <br /> access road. A new oil and gas facility has been installed in the north section of the site and the overall oil and <br /> gas well configuration differs from the approved Mine Plan Map for the site. The Operator will be required to <br /> update the Mine and Reclamation Plan Maps in the future to accurately depict the wells at the site. The Operator <br /> stated they intend to submit an amendment to the approved permit prior to commencing mining activity. <br /> During a records review for this inspection, DRMS noted that the permit acreage currently recorded for this site <br /> is 158.77. It is believed that this is a DRMS records error and that the permitted acreage should be 312 acres as <br /> stated on the initial application form, with a currently approved affected acreage of 158.77, however the <br /> documents in the existing permit file are somewhat unclear. DRMS would like to request clarification of this <br /> acreage discrepancy from the operator so that our records can be corrected if necessary. <br /> Photographs taken during the inspection are attached.
